r <br />3. Michael Donohue, 4625 Porter Rd <br />Request for variance (1123.12). Request 550 square foot variance for garage area to construct new <br />garage (existing garage will be demolished). Violation of Ord. 90-125, Section 1135.02(c)(1). <br />Cha;rma„ Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Donohue. Mr. Gomersall advised that there was a note from one neighbor that they had no objection. <br />Mr. Donohue explained the plans, and it was noted that the old garage would be removed and that <br />the lot was quite deep. Several neighbors came forward at this time and the oath was administered to <br />Ms. Ragle, Mr. Urvan, Mr. and Mrs. Dreher and Ms. Morozko. Neighbors had several objections <br />since the garage would be as large as a barn and visible from across the street. Mr. Dreher stated <br />that tlie garage was bigger than the house. Mr. Donohue responded that he intended to add on to the <br />house. Mr. Dreher believed that this was out of proportion to the house and he should wait until he <br />has enlarged the house to build this size garage. Mr. Donohue explaiued that he wanted to store his <br />cars and have a workshop and when he built the addition to the house he would need to store <br />bu.ilding materials in the garage. It was noted that the neighbor next door would have a 50 foot wall, <br />seven feet from her lot. Ms. Morozko, the next door neighbor, noted that this would take up half of <br />lus back yard.. After some discussion and compromise, N1r. Donohue agreed to reduce the garage 26 <br />by 35 feet which would require a 160 square foot variance and is much closer to the normal size of a <br />garage. Duiing the framing of the motion, it was clarified that he would remove the existing garage <br />about 30 days after the new garage was completed. R. Gomersall moved to grant the request of <br />Michael Donohue, 4625 Porter Road, for a 160 square foot variance for garage area to construct a <br />new garage with the proviso that the existing garage will be demolished within 30 days. Violation of <br />Ord. 90-125, Section 1135.02(c)1. The motion was seconded by W. Purper, and unavi.mously <br />approved. Variance granted. . <br />4. D. Rybarczvk, 6697 Nancy Drive <br />Request for variance (1123.12). Request 5 foot side yard variance to install shed. Violation of Ord. <br />90-125, Section 1135.02(d)(1). <br />Chau7nau Gomersall called all interested parties before the board. The oath was administered to Mr. <br />and Mrs. Rybarczyk and their neighbor, Mrs. Scahel, who owned the properry next to the shed. The <br />garage would be right on the side property line. The members were concerned about their being able <br />to maintain the shed with no room on their side. Mrs. Rybarczyk stated that the area was open and <br />there was no fence on that side. Mrs. Scahel had no problem with the shed being on the line. The <br />members were concemed that a new owner might want to put up a fence, and the shed might <br />interfere with drainage. Mrs. Rybarczyk stated that they should deal with the conditions as they exist <br />now, not with what might happen later on. Mr. Rybarczyk was concerned that if he moved the shed <br />over, he would see it from his diniug room window and maintained that the drawing presented was <br />not what he submitted. After some discussion, Mr. and Mrs. Rybarczyk maintained that the shed <br />should be shown 2 foot from the line which would be a 3 foot variance and would allow room for <br />maintenance. T. Kobema moved to grant the request of D. Rybarczyk, 6697 Nancy Drive for a 5 <br />foot side yard variance to install a shed. Violation of Ord. 90-125, Section 1135.02(d)1.
