., <br />will do whatever it takes to muffle the sound. He agreed that the compactor could <br />be enclosed and Mr. Newberry stated that it was double insulated at present. Mr. <br />Bingham clarified that they did need to be able to get the ba.les out and loaded <br />so there would be an opening. Mr. Newberry stated that the bin or dumpster would <br />be an the south end and is direetly attached to the compactor and reiterated that <br />they could not relocate it to the west side of the store because of the interior <br />setup. Mr. Bingham stated that this would be a ma.jor change. Mr. Newberry <br />explained how the operation worked and how the merchandise- was off loaded and <br />received and why the internal operation of the store dictated where the loading <br />dock ard compactors should be. Mr.. Bingham assured them that they would handle <br />the noise. Mr. McKay asked if they were going to enclose the truck docks. Mr. <br />Newberry responded tha.t the truck docks were to be depressed 4 feet from floor <br />level with the 8 foot mound and 6 foot fence. A resident stated that he had <br />visited 4 Wal-Marts in the area and pointed..out on the plan where one of.them had <br />a dock in a different location. Mr. Newberry responded that there were different <br />prototypes in the area, but could not remember any docks in tha.t location. Mr. R. <br />Kouri, a member of the audience,. suggested that perha.ps they could bring a wall <br />out and eliminate some of the noise. The members expressed their views. Mr. <br />Koberna noted that the building plan was slightly different from the site plan <br />and he does have some doubts in his mind, but he still believed that it would be <br />better to have the building and the green area next to the condominiums. He <br />stated that even if they could stop Wal-Mart something else will go in there, <br />maybe a 20 foot office building. Mr. Gomersall stated that he had some doubt <br />about the sourd proofing. He asked for some response to his suggestion that there <br />be a 75 foot minimum 75 foot setback even if they cocked the building. Mr. <br />Newberry tried this on the plan and explained that they needed the 40 feet <br />between the face of the T.B.O. and the docks along with other problems <br />maneuvering into the area. Mr. Gomersall stated that they say they are trying to <br />work with the city, but they cannot do anything that is suggested. Mr. Bingham <br />asked why 75 feet and what other solution could there be. Law Director Gareau <br />asked if the extra 25 feet would make a difference in how the sound carries. Mr. <br />Gomersall responded that if they do not get the extra 25 feet, the mound cannot <br />go as high. Mr. Newberry maintained that the entire length of the mound would <br />remain 8 feet above floor level regardless. Mr. Gomersall suggested that they <br />shorten the garden center. Mr. L. Orlowski, vice chairman of Planning Conunission <br />was sworn in at this time. He maintained that that there was only a 20 foot <br />landscape buffer between the property line and the asphalt at the southern end of <br />the building thus making it difficult to maintain the 8 foot mound that they have <br />mentioned. He stated that the Planning Commission had the same concerns about the <br />proximity of the compactor and the truck docks to Clareshire Condominiuins. He <br />advised that the Commission has not discussed landscaping for the area, they have <br />only seen a preliminary plan. Mr. Gomersall stated that if the board.granted a <br />variance it would be conditional on the mounding. Mr. Orlowski believed that the <br />mound would drop considerably at that end of the building. He stated if Wal-Mart <br />was willing to concede additional land from their property line, that would <br />enhance the height of the mound from the end of the build.ing to Country Club <br />Boulevard. Mr. Gomersall noted that there were no sidewalks on Country Club <br />Boulevard, and he agreed with Planning Commission that they.should be installed <br />since it is in the Master Plan. Mr. Newberry stated that they plan to install <br />sidewalks an Country Club. Mr. Bingham again explained their concern on <br />increasing the setback and suggested that if they could get a reduction of the <br />landscape buffer between their property and Corporate Center they might be able <br />to move 5 or 10 feet, but he doubted he could move 25 feet.
