Mr. Newberry advised that <br />without some relief from the 25 foot setback along the Corporate Center comon <br />line, they could not make a 75 foot buffer work. They do believe that they could <br />add 10 feet to the buffer and would agree to enclosing the trash compactor. In <br />considering the noise, Mr. Purper did not believe that there would be much <br />difference between 60 and 75 feet. In reference to encroaching on the.Corporate <br />Center parking and buffers, Mr. Papandreas, advised that they Aid have lease <br />agreements with their tenants, so there wou3d be a problem removing any parking <br />spaces. Mr. Gomersall reiterated several issues, the trash compactor would have <br />to be enclosed, the line on Brookpark Road would be.required to be nothing less <br />than the distance currently from the right of way on Brookpa.rk to the Colebrook <br />Condominiums. R. Gomersall moved to approve for the Wal-Mart Stores, Inc. for the <br />property loeated on Brookpark Road, east of the Westbury Apartment and west of <br />Colebrook and Clareshire CondominiUms, a 40 foot variance from the east property <br />line and a variance for the build.ing setback from the Brookpark right of way <br />which is to be nothing less than the distance currently from the right of way for <br />the adjacent Colebrook CondominiUms which is less of a variance than was stated <br />(and is approximately a 67 foot variance whieh is less than the requested 72.37 <br />foot variance requested) and with the conditions that the landscape buffer on the <br />east property line will be 8 feet high from the grade level of the condominiUm <br />side and nm the fu11 length of the east property line with the exceptian tha.t it <br />be held back 20 feet from Country Club Boulevard right of iaay line for visibility <br />reasons. A 6 foot board on board fence must be installed on the top of this mound <br />for its entire length with greenery and a double row of evergreen trees planted, <br />half on one. side and half on the` other. There will be no paved road behind the <br />building except for the safety vehicle road shown on the plan and the trash <br />compactor shall be enclosed, double insulated and sound proofed, seconded by T. <br />Koberna. The oath was <br />administered to Mr. Sedlack, representing Mr. Wolf who presented a letter from <br />O.D.O.T. advising that this type of devise is exempted under Section 5516.06 of <br />the Ohio Revised Code, but advised that this approval is contingent upon placing <br />the device.on private property and not an the State's right of way. Mr. Sedlack <br />explained that they would need a 10 foot height variance and a 32 square foot <br />variance so the sign could be seen above the interstate fence. M. Wolf, parcel 234-11-141, North Olmsted <br />Industrial Park, for a 10 foot, height variance for the total sibn structure of a <br />temporary real estate sign; a 32 square foot variance; a 5 foot location variance <br />from a side property line, and a 645 foot location variance for encroachment of <br />primary highway system with the notation tha.t O.D.O.T. has sent a letter of <br />approval, seconded by W.
