He believed that if commercial <br />development is allowed on Brookpark Road it will become another Lorain Road. He <br />sumnarized that granting this variance wi]1 set a precedent, that the developer <br />has other options, both on this property, and in other areas of the town; and he <br />requested that the board not allow the variance along Brookpark Road. Mr. <br />Wideman, representing a group of concerned - citizens, _stated if Wal-Mart <br />maintained the 100 feet between the building and the condominituns, they would <br />still have the required parking spaces. He noted,that the residents of the condos <br />would be looking at 535 feet of cement block, 26 to 27 feet high and stated that <br />the Planning Commission did not recommend that this variance be granted. He <br />advised that when the Jefferson Place Condominiiuns and Westbury Apaxtments were <br />built, no variances were requested. He maintained that no plantings or evergreens <br />are going to hide this concrete lilock builciing and this will set a precedent. <br />Mrs. Schuler, a resident of Colebrook GondominiUms was sworn in at this time. She <br />wanted the board to be awaxe that there was a playground and a pnol ri;ht behind <br />this property and was concerned about the sa.fety of the children considering the <br />proximity of the truck docks and compactor. Mr. Gomersall wondered if the <br />children would climb over a 8 foot mound and a 6 foot fence and pointed out that <br />it was more than 50 feet at that point the setback ran from 76 feet down to 50. <br />She responded tha.t there would still be trucks, funes, and noise and the board <br />should be concerned about the safety of the citizens. Councilman McKay advised <br />that these condominiinn setbacks were the code in 1962'and believed that the codes <br />have been improved since then. Mr. Bingham, regional representative of Wal-Mart, <br />responded to statements made. It had been stated at the beginning of the meeting, <br />that no action of the board would set a precedent, that a unique shape of the <br />. property was considered to be creating a hardship and he mairitained tha.t the <br />shape of this property as it relates to,their business and their use of the <br />. property is why they are asking for the variance. They are asking for their <br />building to be about the same- distance from Brookpark as the condominituns are and <br />wliile those buildings have no landscaping, they are planning to install <br />substantial,landscaping and buffering up against Brookpark. He stated that, on <br />the side adjacent to the condominitmis,. they are proposing the mounding and <br />bufferirig so these things tha.t the residents are concerned about do not occur. In <br />response to Mr. Gomersall's question, Mr. Newberry clarified that the standard <br />building would be a painted split face concrete block, not just a cinder block. <br />Mr. Bingham advised that in dealing with the seller they have achieved a color, <br />texture ancl design that ma.tehes the requirements of the sellers and is not <br />typical of their standard building. Mr. Gomersall wondered if the residents <br />understood, if the building conformed 100 foot setback, they were permitted to <br />park cars in 75 feet of that. 100 foot and there would be lights and activity <br />behind the building. They are proposing to have all green space behind the <br />building with a mound, a fence, a double row of trees and no roadway. He further <br />stated that he does not believe there is enough area in back, is absolutely <br />opposed to the compactor back there since it is noisy and right next to the <br />people, and he would like it double insulated and.relocated to the west side of <br />the loading dock. He suggested a compromise of a 75 foot setback on the entire <br />east side: Mr. Maloney stated he was opposed to the location of both the truck <br />docks and the trash compactor, and believed that 50 feet was too close. He <br />thought that the building could be redesigned i.n order to,relocate them. Mr. <br />Koberna questioned why this building was larger than the building at Dover and <br />Lorain. Mr. Newberry responded that this building would be no larger tYian the <br />other one after the construction of the planned 30,000 square foot expansion. <br />Because of tYiis location, Wal-Mart believed it was Worthwhile to build a building <br />7
