In reference to the hours of operation, Mr. Bingham advised <br />that the Brooklyn and Macedonia stores will be open from 7:00 a.m. to 10:00 or <br />11:00 at night with no restriction of when truck traffic is allowed and the <br />compactor might be operated prior to and after business hours. Mr. Conway advised <br />that North Olmsted does ha,ve a restriction an delivery hours. Mr. Bingham stated <br />advised that the noise level of their compactors was minuscule even compared to <br />the noise ordinance of the city. He further stated tha.t typically there would be <br />4 to 8 truck deliveries a day by Wal-Mart trucks and all of them would use the <br />loading dock. Mr. Newberry clarified all delivers were made by Wal-Mart trucks <br />fran a distribution point and their are a minimal number of trucks, there might <br />be a Federal Express or U.P.S. delivery on occasion. He advised tha.t Wal-Mart <br />recycles all packaging and normally stores it inside the building where the <br />bailer is located, occasionally they might have some of these bales outside. Mr. <br />Gerrity was sworn in at this time, and advised that he has visited 3 stores and <br />the baling done inside is stored outside in the parking lot. Mr. Conway advised <br />that if they wanted to store it outside they would have to designate an area and <br />Planning Commission could require screening. Mr. Gomersall stated tha.t the <br />figures they are using are incorrect and would put tlie buildings closer to <br />Brookpark than.the condominiums. Mr. Newberry responded that the figure is about <br />6 feet off. They located the Colebrook Condominituns in reference to the Brookpark <br />boundary line and the northwest corner of the condominiums to the Brookpark right <br />of way which is 332 feet, so they are encroaching a little bit further by a <br />nominal amount. He advised that what they are offering far more landscaping than <br />is required either by the code or by the agreement with Biskind in return for <br />this encroachment. They are proposing to add over 200 trees to the site, along <br />with mounding and screenin_g to maintain a broken up facade so the parking will be <br />hidden from the street. When a 6 foot tree is placed on an 8 foot mound it will <br />equal 14 feet and from grade the store would not be seen. The only lighting on <br />the rear of the store will be wall mounted lamps over the frame of the emergency <br />door and is only intended to wash that area and would be behind the mound. Mr. <br />Bingham clarified that the wall pack tmi.ts can be shielded and focused down so <br />that there is no spill over and they would achieve that same effect in this <br />portion of the parking lot so they can achieve a lighting pattern with no spill <br />over. Mr. Purper wanted to make sure that Mr. McKay and the residents were aware <br />that if the 100 foot setback is maintained, that there can be parking and truck <br />traffic back there. Mr. Skoulis stated that he was at the Planning Conuni.ssion <br />meeting and there would be no parking back there, there would anly be an 8 foot <br />mound, a 6 foot fence, an emergency access road. The members did not understand <br />it this way. Mr. Gomersall understood that Planning"Coimnission had offered to <br />landbank parking, but the developer would be within his rights to paxk cars in 75 <br />feet of that area or have trucks driving through and that would be worse than <br />having 75 foot of green. Mr. Purper is concerned that the residents do not <br />understand this when they insist on keeping the 100 foot setback. He wondered if <br />they would not rather look at the wall. Mr. Gomersall would like 75 feet of green <br />area with the 8 foot high mound and a 6 foot fence on top with evergreen planted <br />on each side and with low lights that will not go over the hill. He could not <br />understand why they would want the store on the other side so they would be next <br />to the parking lot with all the lights and traffic. Mr. Skoulis stated that the <br />Planning Commission ha.d asked the associations to take a poll on that. Mrs. <br />Schuler advised that the petitions that were submitted tonight and those <br />submitted previously had two sections, the first stated that they did not want <br />Wal-Mart at all and the second stated that if it had to be there, they would <br />prefer the store with the truck docks and all by the Corporate Center.
