beyond the front setback of the abutting property, seconded by W. Purper, and unauiinously
approved. Variauce granted.
9. Lewis Cmjak, 4555 Selhurst Ave.
Request for variance (1123.12). Request 241 square foot variance for. area of swiimning pool
wluch will exceed the permitted 20% coverage of rear yard area. Violation of Ord. 90-125,
Section 1135.02(d)(2).
No representative was present. A neighbor who lives to the rear, Ms. Grady, was present and was
sworn in. She was concerned because the pool would be 10 feet from her property, but 33 feet
from his house. This was not why the needed a variance, but this above ground pool will
practically cover the whole yard. 1VIr. Purper noted that if he put it closer to his house he would
have to remove a tree. The members agreed that this was a large pool, and perhaps it could be
reduced by 3 feet wluch would peduce the variance by about one half.. The request will have to be
tabled until the next meeting so Mr. Crnjak can be present and Ms. Cvrady stated that she would
be present. R. Gomersall moved to table the request of Lewis Crnjak,.4555 Selhurst Ave, until the
June meeting, seconded by T. Koberna, and unavimously approved. Request was tabled.
10. 7orlyu Wlutmore, 6330 Christman I)rive.
Request for variance (1123.12). Request 5 foot rear yard variance to install roof over a patio.
Violation of Ord. 90-125, Section 1135.08(a).
No representative was present. R. Gomersall moved to table the request of Jorlyn Whitmore,
6330 Christman Drive, until the June meeting, seconded by W. Purper, and unanimously
approved. Request was tabled
Law Director Gareau advised that the board cou1d dismiss a request if the applicant was nbt
present and then they would have to refile. It was decided that since the date of the meeting had
been changed that there might have been some confusion.
11. Beth Scebbi, sublot 1, vacant property located south of 3570 Clague Road.
Request for variance (1123.12. ) Request 2 foot corner lot setback variance to construct new
dwelling. Violation of Ord. 90-125, Section 1135.06B. Also request variance to have fence in
corner lot setback (minimum 25 feet from property line) which would be adjacent to the front
setback ofthe abutting house. Violation of Ord. 90-125, Section 1135.02.(f-2).
Chairman Gomersall called all interested parties before the board. The oath was admiuistered to
Ms. Scebbi who explained that she wanted a 6 foot fence from the corner of the house to the ditch
and would prefer that-it be out 5 feet more than the 25 she had requested. She clarified that if the
drive was 20 feet from the side walk she would still have visibility backing out of the garage. The
members agreed and after some discussion, it was decided that she would need a 30 foot variance
to put the fence approximately 20 feet from the sidewalk. There was no problem with the 2 foot
side yard setback for the house. J. Maloney moved to grant the request of Beth Scebbi, sublot 1,
vacant properiy located south of 3570 Clague Road for a 2 foot corner lot setback variance to
construct new dwelling and also to grant a 30 foot variance for the fence in the corner lot setback
6
