Boyle, T. Koberna, J. Maloney, W. Purper, and R Gomersall <br />Also Present: Assista.nt Law Directory Dubelko, Building Commissioner Conway, and Clerk of <br />Commissions Oring. Law Director Gareau arrived later in the meeting. <br />Mr. Gomersall corrected the minutes of the May Sth., the first case, during the roll call on the - <br />motion, delete the words "Motion carried." and 'msert `2Vlotion failed to pass.' J. Maloney <br />moved to approve the minutes of May 5, 1994 as corrected, seconded by W. Purper, and <br />unaniinously approved. <br />ChairnLan_ Gomersall advised those present that each of the board members had viewed the <br />premises involved in each case and that 3 affirmative votes would be requ.ired for approvaL Each <br />case would be judged on the physical situation peculiar to itself so that in no way is a judgment <br />rendered considered to be a general policy judgment affecting properties and like situations <br />elsewhere. <br />Boston Chicken, 26440 Lorain Road. <br />Request for variance (1123.12). Request 10 foot variance for landscape buffer on east and.west <br />property lines. Request 10 foot rear yard variance for landscape buffer on north property line. <br />Request variance for width and area of lot (cha.nge of use). Violations of Ord. 90-125, Sections <br />1139.07, and 1139.06. Also request va.riance to place free standing sign in prolu'bited triangular <br />area. Violation of Ord. 90-125, Section 1163.12(b). Tabled at the meeting of May 5, 1994. <br />Chairman Gomersall called all interested parties before the board. The oath was administered to <br />Mr. Landru, representing Boston Chicken, advised they now have revised plans which must be <br />retu.med to Planning Commission for another referral back to this board. He requested that this be <br />continued until the next month. B. Gomersall moved to continue the request of Boston Chicken, <br />26440 Lorain Road, u.ntil the next meeting, seconded by T. Koberna, and unanimously approved. <br />Request continued. <br />2. Lewis Crnjak, 4555 Selhurst Ave. <br />Request for variance (1123.12). Request 241 square foot variance for area of svvimming pool <br />which will exceed the permitted 20% coverage of rear yard area. Violation of Ord. 90-125, <br />Section 1135.02(d)(2). Tabled at the meeting of May 5, 1994. . <br />Chairman Gomersall called all interested parties before the board. The oath was administered to <br />Mr. Crnjak, who explained that he had been unable to attend the previous meeting. Mr. <br />Gomersall stated that there was a neighbor at the last meeting who objected to the size of the <br />pool. The members had agreed and he asked if Mr. Crnjak would consider reducing the pool to <br />24 feet instead of 27 feet. Mr. Crnjak stated that he wanted the 54 inch deep pool, because a 24
