? . . d
4. Joseph and Edith D'Agostino, 3229 Twin Circle Drive.
Request for variance (1123.12). Request 5 foot, 4 inch rear yard variance to replace existing shed.
Violation of Ord. 90-125, Section 1135.02(a)(4).
Variance reduced from the one denied. on May 5, 1994.
Chairman Ciomersall called all interested parties before the board. The oath was admiuistered to
Mr. and Mrs. D'Agostino, and Councilmau D. Lind. Mr. Gomersall advised Mr. Lind that he had
spoken with Mr. D'Agostino who stated that he had to have a 7 foot variance, he could not place
the shed at the location suggested. Mr. Lind responded that he u.nderstood that they would have
settled for a 5 foot variance, and had they known that at the last meeting, they would have
agreed to it at the last meeting. This request would put the shed about 4 foot, 8 inches from the -
fence. Building Commissioner Conway advised that he was told that the fence was inside the
property line. Mr. Gomersall clarified that the shed would have to be measured from the property
line, not the fence. Mr. Conway stated that there was an engineering site plan, and it could
probably measure it with some accu.racy. Mr. Maloney noted that a wrought iron peg was shown
on the survey, so they could probably find it. Mr. Agostino was still concemed that he would
have to move the sidewalk, but agreed to accept this variance. R. Gomersall moved to grant
Joseph and Edith D'Agostino, 3229 Twin Circle Drive, their request for a 5 foot, 4 inch rear yard
variance to replace existing shed, seconded by T. Koberna, and unauimously approved. Variance
granted.
The meeting was adjourned at 9:15 p.m.
le
R. Gomersall, Chairmau
B. Oring,
of Commissions.
7
