The oath was aciministered to <br />Mr. LeBlanc and Mrs. Oldack, a neighbor. Mr. LeBlanc advised that he had revised his request <br />to install a mobile cappuccino u.nit on a 12 by 40 foot concrete pad behind the current parking lot. <br />He presented a drawing of a different type of a kiosk unit that he would like to install.. Building <br />Commissioner Conway explained that there were other problems, the dance studio ui the building <br />was closed for the suinmer, so he did not address parking, and if this is going to be a year round <br />business, he will have to approach it from a totally different aspect. Mrs. Oldack stated that she <br />has a problem with his customers parking in the lot for her ice cream stand next door. Mr. <br />LeBlanc stated that he has a problem at night with cars from her business. Mrs. Oldack also had a <br />problem with people going to the dance studio. Mr. LeBlanc agreed that he would ask for a <br />temporary variance at this time, and re-apply later for a permanent structu.re. Ms. Boyle pointed <br />out that this is an unapproved parking area. Mr. Conway further advised that there was no tent <br />involved in the original request and that the tent is blockiug some of the spaces that he does have. <br />Mr. LeBlanc stated that he has tables and chairs outside at night but maintained that people park <br />in front, not on Mrs. Oldack's property. Mr. Conway did not believe it would be possible to park <br />in front of this equipment without cars hanging over the sidewalk, and noted that Ue had never <br />received a accurate site plan. Mr. Conway would like the tent and the seating area moved back to <br />the lawn, leaving the paved area for parking even if this is only until September. He clarified that <br />the whole business was in the 75 foot front setback. The members had none of the information <br />that Mr. LeBlanc had presented this evening. It was clarified that this could only be there until <br />September 12th. He would like to put in a slab later that in front of the residence, adjacent to the <br />dancing school, and put another slab in to display a mobile drive by unit which will be used to <br />train operators of the expresso equipment. J. Maloney moved to grant the request of Andre <br />LeBlanc, 30449 Lorain Road, for a temporary variance to conduct business in the 75 foot front <br />setback with the condition that all business activity will be conducted on the grass area and also to <br />grant a temporary variance to park a mobile unit an unapproved parking area. Violation of Ord. <br />90-1225, Section 1139.07 and 1161.11. This variance request is good until September 12, 1994. <br />The motion was seconded by R. Gomersall. Roll call: Maloney, Gomersall, and Koberna, Yes. <br />Ms. Boyle, no. Motion carried. Variances granted. At this point, Mrs. Oldack stated that he got a <br />variance for a garage to store an antique car and now he is using it for a business. <br />9. Fit bv Five, 28641 Lorain Road. <br />Request for variance (1123.12). Request 68 square foot variance for sign area allowed for a <br />business unit not on the ground floor of a building. Also request variance for second wall sign <br />(one allowed per unit). Violation of Ord. 90-125, Section 1163.10(B)(2) and 1163.12(A). Please <br />Note: Heard by the Architectural Review Board on July 20, 1994. <br />Chau7nan Gomersall called all interested parties before the board. The oath was aciministered to <br />Mr. J. DeMarsh, owner and operator of the facility. He advised that when he installed the pole <br />sign insert, he was unaware that he needed a permit for it. Building Commissioner Conway <br />explained that the Architectural Review Board had recommended that one wall sign should be <br />eliminated and only the "Fit by Five" sign should remain. They suggested that it be located on the <br />second floor on the west side above the entry door. Mr. DeMarsh stated that since they.occupy <br />the whole second floor, they believed this would balance out the signage. The members agreed <br />with the A.R.B. Mr. DeMarsh agreed to one sign. R. Gomersall moved to grant Fit by Five, <br />28641 Lorain Road, their request for a 40 square foot variance for sign area allowed for a <br />4
