.? 4 <br />r ? <br />M <br />15. John Zerkie, 23801 Maple Ridge Road. <br />Request for variance (1123.12). Request 18 foot, 4 inch rear yard variance to construct an <br />addition ancl a 6 foot variance for distance between addition and detached-garage. Violation of <br />Ord. 90-125, Sections 1135.08(2) and 1135.02(c)(2). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to <br />Mrs. Eggelmeyer, Mr. Zerkie's daughter, and Mr. Schuerger, contractor. Mr. Gomersall advised <br />that when a variance is requested between a house and a garage, the garage has to be fireproofed. <br />The members had no questions on the request. J. Maloney moved to grant the request of John <br />Zerkie, 23801 Maple Ridge Road, for an 18 foot, . 4 inch rear yard variance to construct an <br />addition and a 6 foot variance for distance between addition and detached garage subject to the <br />Building Departments requirements for the fire code. Violations of Ord. 90-125, Section <br />1135.08(2) and 1135.02(c)(2). The motion was seconded by W. Purper, a.nd unanimously <br />approved. Variances granted. <br />16. Kristen Dudas, 24821 Mitchell Drive. <br />Request for variance (1123.12). Request 29 foot rear yard variance to construct family room <br />addition. Violation of Ord. 90-125, Section 1135.08(a). Also request special permit to add to <br />non-conforming dwelling (rear setback). Specialpermit required Ord. 90-125, Sectiou 1123.06. <br />Note: variance granted far rear yard setback Apri117, 1963 prior to construction of house. <br />Chainnan Gomersall called all interested parties before the=board. The oath was aclministered to <br />D. Williams, contractor. Under these unusual conditions, none of the members had any objections. <br />T. Koberna moved to grant a request of Kristen Dudas, 24821 Mitchell Drive, for a 29 foot rear <br />yard variance to construct family room addition. Violation of Ord. 90-125, Section 1135.08(a). <br />Also to grant a special permit to add to non conforming dwelling (rear setback). Special permit <br />required Ord. 90-125, Section 1123.06. Note variance granted for rear yard setback April 17, <br />1963 prior to construction of house. The motion was seconded by R. Gomersall, and unanimously <br />approved. Variances granted. <br />OLD BUSINESS: <br />Wendy's Restaurant, 26650 Lorain Road. <br />Request for variance (1123.12). Request 10 foot variance for buffer on west property line. <br />Violation of Ord. 90-125, Section 1139.07(table). Please Note: previous variance granted April <br />6, 1994. <br />Chaii7nan Gomersall called all interested parties before the board. The oath was admivistered to <br />Mr. Dixon, architect, and W. Kikendahl, representing Wendy's, who explained that they had not <br />been able to get the easemeut from the property owners next door even thougla they believed the <br />easement would be more to their advantage than to Wendy's. Mr. Kikendahl explained that the <br />ovvuers had told them that there was an easement, and when it could not be found they had <br />indicated that they would agree to it, however on the advice of their lawyer, they turned down <br />two different agreements, and would only grant one for a 30 day period which would do Wendy's <br />no good what-so-ever. They then presented revised plans showing the driveway entirely on their <br />properiy which will require a variance for the 10 foot landscape buffer that is required. They will <br />be constructing a curb, about 2 foot wide and 18 inches high, with some cut out areas for <br />plantings, and at the request of the Planuing Commission they will put in some reflective <br />delineators. They will only lose one parking space with this change. Mr. Kikendahl advised that <br />7
