4. <br />maintauung ditches is more of a problem because the city does not have good access and they are not <br />mowable. He believed that tlie biggest danger to any retention is residents throwing branches and grass <br />clipping into the area. In this case since it will be maintained on a regular basis, home owners could be <br />advised not to do it. He belieued that tlus parcel, parcel "A" and the access, should be deeded to the <br />city. Assistant Law Director Dubelko advised that the Law Director did not think that it made sense to <br />have a small number of hoine owners bearing the cost of maiutaituug a system that would benefit a <br />large numb.er of home owniers in the neighborhood. Mr. Basalla agreed that deediug it to the city would <br />be the best way to handle it. Mr. Herbster asked if the developers would be willing to uiaintain it or <br />contribute to the mainteuance of the ditch for a five year period to benefit the city while they are <br />building. Mr. Basalla stated that they might be vvilling to make a contribution. Mr. Brennan believed <br />that Mr. Herbster was conceiued about whether this was going to work the way it was presented. Mr. <br />Basalla stated that tlus would be part of the iinprovement plans, they would present as built drawings, <br />and they would post a bond for its peiformance for a period of time. They previously offered to build <br />the retention system first. Mr. Deichmanu advised that Section 1100.04 requires posting a performance <br />bond for all public unprovements wluch iucludes roads, water mains, storm and sanitary sewers and <br />retention facility and also a two year inaintenance bond inust be posted upon completion of the <br />project. They look at all projects for the first two years so that if'something breaks they can be called <br />back to fix it. He further explained that they would also be required to get a storm water control permit <br />from the EPA to control erosion, since these procedures must be in place before grading begins in <br />order to preveut sed'unent from clogging drainage chaunels. J. Lekan, a resident, questioned how this <br />retention would tie in to the sewers since there seems to be a problem with how they are joined on <br />Sharon and Carriage, wluch creates almost au opposed flow situation. He believed that this might still <br />cause problems with the water released from tlus system, Mr. Deichmann explained how the sewers <br />were coming together, and were not opposing each other so both flows were merging. Mr. Lekan <br />suggested that the pipes be separated. He also would like some foliage left around the retention system <br />siuce it will adjacent to lus back yard. Mr. Deiclunanu responded that they had redesigued these sewers <br />when they made 'vnprovements on Rice ditch, but he agreed that it, would be an improvement if the two <br />lines were separated. Mr. Hennau, a resideut, was concerned about tying in Maple Ridge to W. 231st., <br />since West 231 has become so heavily traveled with the condominiums and the supermarket that was <br />built and also because drivers are usiug it as a cut tluough to avoid the Clague Road intersection. He <br />believed that most people in the new and surrouuding developinents will use West 231 to avoid going <br />out onto Clague Road avd the road caunot take more traffic because it is not in good condition. Mrs. <br />Spaulding questioned how the water from Bridgeport I and II would get into the retention basin and <br />wondered if the water would go into the existing outlets or if there would be additioual inlets. Mr. <br />Basalla explanied that all the water would ruu be routed away from Sharon and Woodview system and <br />directly iuto the Bridgeport system before going into the basin. Couucilman Lind stated that he has <br />never been in favor of above grouud reteution systems, but upou comparing this design with what is <br />required and what is existing, he believed tlus will benefit people in the entire uortheast quadrant of the <br />city. Councilman Miller advised that he and the residents have been meeting with Mr. Basalla and Mr. <br />Whitlatch ou tlus proposal. One of the residents is an engineer who could not be present at this <br />meeting, but he was unpressed with tlus gentleman's reactiou to the proposed system and believed it <br />would be a substantial beuefit to the city. The proposed above grouud system has resolve many of the <br />concerns about safety aud aesthetics. He, too, has been opposed to above ground retention, but tlus <br />would be the exceptiou since it will a positive benefit to the comnwuty. Ms. Deucker presented <br />copies of an article that appeared in the paper pertaining to flooding basements causing illness and <br />death of cluldren on the east side of Clevelaud. She meutioued that some children in another area of <br />Nortb Olmsted had been iufected with encephalitis. She was uot opposed to above ground retention, <br />but she did not want stauding water as there is in Rice ditch because it was not engiueered properly and <br />she did not want exacerbate the existuig inosquito problems.
