Consolidation and Lot Split Plat into two (2) sublots, which is the site (combiued) of <br />the previously approved McCoiznick Place slioppiug center. Location is the uorth side of Lorain Road <br />between Clague Road and West 231 Street. Zouivg is Retail Business, General, entirely. Note that <br />additional cross-easemeuts will probably be required. Tabled at planning commission on September 26, <br />1995. <br />Mr. Papandreas, representing Sears Hardware, one of the stores ui the cevter, advised that the <br />subdivision complies with all applicaUle ordiuances. He explaiued that the lot split was requested by <br />Sears Hardware. Assistant Law Director Dubelko advised that he did discuss tlus with the Law Director <br />aud Building Coimnissioner Couway, aiid it is pennitted by code provid'uig each lot covforms to code, <br />and the two Uuildiugs are separated by a fire wall and meet the buildiug codes. Mr. Conway advised that <br />he has not seen the detailed Uuildiug plans as yet, but the developer has indicated tliat he will comply to <br />the codes. He explained to IVIi-. Bi-emlau that if two abuttiug properties are beiug co-developed, the code <br />perinits building right up .to tlie property line as loiig as there is a fire wall complete with parapet between <br />thein. Mi-. Breiman questioned this since tliis proposal oiigiually came Uefore the coimnission as one <br />building, and was changed after the fact. He is concenied about having buildings so close together. Mr. <br />Conway noted that the appearance has not changed at all, it will appear as one building. Mr. Dubellco <br />explaiued that the code specifies that a buildiug either has to be right ou the property line or 10 feet <br />away, it camiot just Ue 3 or 4 feet off tlie line. He pointed out tliat it would uot be possible to have <br />several buildiugs right oii the line sittce there would be no access to tlie 1•eat- unless there would be <br />access on the side streets. Mr_ Tallou iioted tliat tliis inight be au advautage with two "bowling alley" <br />lots because it would cut down ou the curU cuts ou Lorain Road. M.r. Conway also stated that if two <br />developers wanted to do this, planiuug commission could always require some additional landscaping ou <br />the sides. R.
