.? <br />Wal-Mart has requested to have two phone booths installed outside. Mr. Tallon wondered why the <br />telephones were to be installed outside when they have such a large foyer. It was speculated that it <br />was to keep cluldren out of the foyer. There was no problem with the phones. <br />Great Northern Mall is going to plant some trees along Brookpark Road in conjunction with the <br />parking lot improvements that were approved previously even though landscaping was uot a <br />requirement of the commission, just a suggestion. Mr. Zergott, of the architectural review board, has <br />been pleased with what has been done. The members had also asked them to look into realigning the <br />Brookpark Road eutrance. They had no problem with the landscaping. <br />Nightfall Night Club had requested a minor change, but Mr. Tallon would like that to come back to <br />the commission since they do not seem to be doing what was required. <br />VIII. NEW BUSINESS: <br />No items. <br />IX. OLD BUSINESS: <br />F. Bower, Shore West Construction, discussion of Multi-Family codes as explained in his letter of <br />October 19, 1995. <br />Mr. Bower had previously submitted a letter pertauung to the new codes as they relate to the inulti- <br />family district. He believed that reduciug the density iu the multi-family district from 16 units per acre <br />to 12 units per acre will put him at a disadvantage if he attempts to develop the 10 acres he owns at <br />the coruer of Broolcpark and Clague Roads. This is a reduction of 25% in density from what was <br />previously allowed and would keep them from competing with other previously developed sites. He <br />further noted that, unlike other codes, a multi family property can be developed only for multi-family <br />or for whatever use is adjacent to the to it, in other words, it could not be developed for duplex or <br />cluster district and little property is zoned for these uses. Code in other cities would allow it and he <br />would ask that tlus restrictiou be removed. He maintained that it was not fau to reduce density aud <br />put plaiutiug restrictious on one district and asked that it be changed back to what was formerly <br />enforce. He offered to present au ordinance that would alter the district. Mr. Bower stated that many <br />people in the city were not aware of the change and he was woudering if this stipulation was slipped <br />in. Mrs. O'Rourke believed that there must be a reason for the change. W. Bower believed that a <br />consultaut was hired who was used to this density in the commuuity he works in. Mr. Herbster stated <br />that standards aud laws do change, and Mr. Bower would be at the same density as anyone who build <br />from now on out. Mr. Bower estimated that tlus would be a loss of three or four hundred dollars. He <br />has owned the property for about 20 years, and Mr_ Herbster noted that he could have developed it <br />sooner, so the city should not be respousible because he did uot. Mr. Tallon noted that he bought the <br />property for far less thau it would cost now. Mr. Bower responded that if he builds at these standards <br />he would not be able to compete with other units that were developed previously. Assistant Law <br />Director Dubelko advised that the plann.ing commission could study this and make recommendations <br />that it be changed, and that they do have to consider if the property can feasibly be developed <br />competitively. He stated that the BZD Committee had looked 'at tlus and suggested that Mr. Bower <br />come to planning commission. The developer could also present a proposal that did not comply aud <br />ask for variances. Mr. Manning asked if Mr. Bower would be taking a loss on the property. Mr. <br />Bower repeated that if they built a complex identical to Butternu"t Ridge Apartments, they would be at <br />7
