Mr. Brennau noted that <br />Butternut Ridge Apartments were adjacent to I-480, Moen Office Building, aud a cemetery, lus <br />property abutted single family homes on two sides. Mr. Tallon advised that the commission would <br />study this before making a decision. Building Commissioner Conway advised that wherever a <br />document like tlus is adopted, problems can be found later on. He agreed that it does not make sense <br />that inulti family property could not be developed as two family, if it can have 12 suites per acre, why <br />not two family dwellings. Mr. Dubelko advised that the code took two years to rewrite, and the advice <br />that the Law Department gave at the time, was to get it passed and then if there are problem when it is <br />implemented, it can be amended. He noted that there are other issues that have come up since it was <br />in effect. Ms. Cameron Alston asked if some of the discussions could be shared with the members. <br />Most of this was done in committee, but it will be researched to see if any of it was discussed at a <br />meeting. Mr. Bower would be happy to appear at any committee and had previously offered to present <br />a proposed ordinance. It is possible that the former chairman, Brian Gorris, might also have lus notes. <br />Couucilman McKay explained that these codes were redone because when some court cases were lost <br />on appeal, the Law Department had advised the city to hire an expert planner, and they hired Mr. Hill. <br />who is a professional planner N1r. McKay explained that the committee consisted of a member of the <br />planning commission, a meinber of the board of zoning appeals, two members of council, the Law <br />Director and the Building Commissioner. He attended a few of these meeting and he does not believe <br />that the codes were slipped through, he believed that they were studied very carefully. He noted that <br />there were recommendations that were not accepted. He does not want to cause anyone a loss of <br />profit, but the feeling was that the residents of the city needed more protection than what they were <br />getting. He noted that the Cluster Home district that was introduced in that code was to Mr. Bower's <br />benefit. Mr. Tallon sat on that committee, and he did not believe that anything was slipped in, and this <br />density was probably based on a code that is used somewhere else. He agreed that, if a higher density <br />zoving caunot be used for a lower density complex, there could be a problem. Mr. McKay suggested <br />coutacting Mr. Hill or checking with the Clerk of Council who might have some minutes pertainuig to <br />it. Mr. McKay does have information on the codes that were not accepted and he would be willing to <br />attend any committee meeting to discuss it. Mr. Conway advised that it is time to re-study the Master <br />Plan as well. <br />X. ADJOURNIVIENT: <br />T7ie December 26th meeting will be canceled. <br />T.
