?. ? <br />and wood bins. He has an option on the property which does abut a residential area. There is a home on <br />the lot which Mr. Miuu.ick would like to renovate. Mr. Manving noted that the mulch that was stored <br />on Kimmich's property had a definite odor. It was determined that the property to the west was zoned <br />General Retail and the property on the east was residential. He is proposing to put a 3 foot mound with <br />3 foot evergreens on it which will be about 50 foot from the fence line. This is in a natural wooded area. <br />Building Coimnissioner Conway stated that this property was zoned General Retail with only a small <br />triangular area that is residential. Mr. Tallon had no problem with the proposal, but advised that <br />buffering the residential neighbors would be a consideration. The forester had viewed the premises and <br />recommended extending the row of pines/spruce trees along the west property line another 50 feet <br />toward Lorain Road to help screen the building, since there is a resident to the west of the site. He <br />further sated that mounding in this area might disturb the existing trees that remain; tree removal should <br />be limited to what is needed for the footprint of the development; dead or objectionable trees can be <br />removed; and he would like to meet with the developer to mark the trees that are to remain. Mr. Tallon <br />suggested that Mr. Minuick meet with the forester again to determine what should be done on the site. <br />Mr. Miuvick stated that during the summer the homes were not visible, but in the fall they could be <br />seen. Mr. Tallon wanted him to make sure that the entire area is screened from the residents to the east. <br />Mr. Mimiick suggested that he would be able to put in some decorative landscaping adjacent to the <br />residents' homes. A pond.iug area is shown on the plans, but Mr. Miunick was aware that retention had <br />to be installed underground. He asked if the business, itsel? was all right. Mr. Tallon responded that it <br />would have to be declared a like and similar business which probably should be similar to landscaping. <br />Mr. Conway advised that landscaping is not specified in the code either, but there are several in the city. <br />Assistant Law Director Dubellco advised that the motion should state that the storage and sales of <br />hardscaping material is a like and similar use in the General Retail District and then, the commission <br />should deal with it as a normal proposal. Mr. Miunick clarified that there would be some heavy <br />equipment on the property: a fork lift; a front end loader; and delivery vehicles. Deliveries will be made <br />to the site by semis and trucks. At present the trucking company get the orders in the morning and <br />delivers at noon on a daily basis. He will not store large quantities on the property, but he needs to <br />display all the various types. If someone orders a large quantity, they ship it directly to his location. In <br />the begiuning there will only one or two people working. Only 4 parking spaces are shown, but most <br />customers will drive in and pick up what they need. He plans to have a brick drive and old street lights <br />on the site. Since there is an odor to the mulch, it was suggested that it be placed toward the west <br />where the forester suggested adding the pines which should help with the odor. The new build.ing will <br />be about 100 feet from the street. He had not thought of selling Christmas trees in the winter, but that <br />might be a possibility. Mr. Conway advised that any sales would have to be kept out of the 75 foot front <br />setback. It was clarified that, if he did decide to sell plant material or Christmas trees, he would not have <br />to come back to the commission since this is permitted. Mr. Pollock, a neighbor to the rear, was <br />advised that the zoning was general retail and that the zoning code does not specify hardscaping. He is <br />concerned that this business will be expanded after he gets this approval. Mr. Conway stated that if he <br />wanted to enlarge the business, he would have to return to the commission. Mr. Ramella, a neighbor on <br />North Court, had talked with Mr. Minnick and wants to make sure that what is agreed to today, is set in <br />stone, he has no problem with this proposal, but he does not want to come back. He wants to make sure <br />that the buffer with the trees remains. Mr. Conway advised that only a 20 foot landscape buffer would <br />be required and there could be parking right up to that, so if the parking were expanded some trees <br />would have to come down. If this happened, the proposal would have to return to the commission and <br />their concern would be the screening of the residents. It was clarified that the one story bu.ilding would <br />be 1,500 square feet. Mr. Ramella was not adverse to this plan as long as it stays this way. Mr. Tallon <br />was advised that this would have to go on to the architectural review board and then either back to <br />planving commission or else onto BZD committee of CounciL.
