cumbersome, not to mention the fact of the additional cost to the citizens by requiring inspectors to pull <br />permits, fill out addendum reports, etc., etc... In addition to that aspect there is the issue of the requirement <br />of the City of North Olmsted to be held harmless on insurance policies. We assure you the proposal that <br />you have been discussing urill rreate confusion, prolong the Real Fstate sale process and raise numerous <br />legal issues which urill inevitably see lawsuits being filed. We pose these following questions to the Board: <br />1. Will it be the Company registered or the individual tnspector? <br />2. What standards and code of ethics will be used in performing the inspections? <br />3. Will a City Inspector follow up on each private inspection or randomly? <br />4. Will the City make the new home oumer or the old home owner .implement repairs? <br />5. Will the City conduct classes to train the Inspectors on any new formats the Ciiy may <br />implement. <br />6. Will Cty Hall be available on Saturday and Sunday to pull permits, as Saturdays are the <br />busiest days in the private home inspection field? <br />7. Who will determine and what standard will be used in issuing registration or licenses? <br />8. Is the City going to extend its umbrella to cover private Inspectors should they be named in <br />a lawsuit based upon some action taken by the City Inspector on follow up inspections? <br />9. How is the City going to police people from coming in and doing an inspection and going? <br />10. Is the City prepared to correct and or repair items which are clearly their responsibility <br />discovered during the course of the inspection? Clearly the sewers are the City's <br />responsibility. <br />It is clear by just listing these few items the numerous issues that your proposed legislation rnises. In <br />addition, if the City was truly concemed about the safe and sanitary condition of its housing stock it would <br />institute an on-going City Inspection Program thereby protecting ALL the residents and not targeting people <br />just selling their homes. It appears to us and many others that this proposal is a vailed point-of-sale <br />inspection, a way to generate fees and an attempt to regulate professionals. <br />In closing, it is our opinion that the Board's proposal shall cause the citizens to incur additional costs, <br />prohibit and restrict the sale of Real Fstate and discournge Professional Home Inspectors from working in <br />the City of North Olmsted, Z'rying to regulate a professional opinion, we think, is outside the scope of the <br />Board of Building Code Appeals.
