?-.?. . <br />? • --., <br />Chairinan Gomersall called all interested parties before the board. The oath was administered to <br />Mr. Dobeck, Mrs. Lopiccolds son in law. Councilwoman Saringer had sent a letter stating that <br />she could see no reason why the variauce could not be approved. The members had viewed <br />the site and had no problem with the request. Mr. Dobeck presented letters from some of the <br />adjacent ueighbors who had no objection. T. Koberna moved to grant the request for Rose <br />Mary Lopiccolo, 6748 Maplehurst Drive, for a 6 inch variance for a fence on a corner lot <br />(already iustalled). Violation of Ord. 90-125, Section 1135.02( fl(1). The motion was seconded <br />by R. Gomersall, aud unanimously approved. Variance granted. <br />7. La-Z-Boy Furniture Gallery 25410 Lorain Road. <br />Request far variance (1123.12). Request variance to have only l loading zone (2 required); <br />request parking variance to have 3 less spaces than required. (Existing BP Car Wash will be <br />demolished. Violation of Ord. 90-125, Sections 1161.13 and 1161.05p. <br />Note: A portion of the adjacent Long John Silver property will be assembled to this property <br />and variances are required for lot size and parking on that parcel (below). <br />8. Lons Jolui Silvers 25482 Lorain Road. <br />Request for variance (1123.12). Request 37,350 square foot variance for area oflot and <br />variance to have 141ess parlang spaces than required. Violation of Ord. 90-125, Section <br />1139.06 and 1161.13. <br />Chau-man Goinersall advised that both requests would be discussed at the same time. Mr. <br />Gomersall called all interested parties before the board. The oath was admivistered to Mr. Stitz, <br />arclutect, Mr. Gruelil, Realtor, J. Sheppard, manager of the store, and Mr. Calmer, who stated <br />that he was representing tlie homeowners on Root Road. Mr. Stitz advised that he had <br />presented a revised plan which will meet the code requirements for parking. Building <br />Commissioner Conway advised that he does show the correct number of parking spaces, both <br />hard surface and landbanked and both I,a-Z-Boy and Long John Silver parking conforms to <br />code except that there are 5 parallel spaces and the code does not recognize parallel spaces. <br />They have also avoided the loading zone variance since they now show one landbanked zone. <br />He has read the letter of agreement between the parties and this is considered shared parking, <br />but since they are not co-developing the properiy, a side yard variance will be needed. Mr. <br />Gomersall questioned who could move into the Long John Silver property. Mr. Conway stated <br />that a restaurant is requ.ired to have an acre and a half, if it were not a restaurant they would be <br />required to have 40,000 square feet and this lot would not comply to that requirement. There <br />would not be sufficient parking for a restaurant if it stood alone. Mr. Stitz stated that there <br />would be a reciprocal cross easement. Law Director Gareau asked if this easement were going . <br />to be recorded and if it would be in perpetuity. He advised that if the board agreed to this <br />variance, it should be required that a copy of the recorded easement be filed with the Building <br />Department and should stay with the records of the property. Mr. Stitz believed that it would <br />be in perpehuty, but would look into that. He continued by stating that they have all the spaces <br />required, and they really would only need a variance for 2 of the parallel spaces, since 85 spaces <br />are required for the two sites, and they are showing 88 including the landbanked spaces. Mr. <br />Gomersall asked what causes the landbanked spaces to be converted to hard surface parking. <br />Mr. Conwa.y stated that usually Planning Commission approves it if the developer maintains <br />that he does not need all the spaces required by code. K however, complaints start coming in <br />8
