% <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - JIJLY 6, 1995 <br />Chairma.n Gomersall called the meeting to order at 7:30 p.m. <br />Present: M. Boyle, J. Maloney, and R. Gomersall. <br />Absent: T. Koberna and B. Purper. <br />Also Present: Law Director Gareau and Clerk of Commissions Oring. <br />J. Maloney moved to accept the minutes of the June 8, 1995 meeting of the board of zoning appeals, <br />seconded by M. Boyle, and u.nanimously approved. <br />Chairmau Gomersall advised all present that each case would be judged on the physical situation <br />peculiar to itsel? so that in no way is a judgment rendered, considered to be a general policy judgment <br />affecting properties and like situation elsewhere. He further stated that three votes are required for <br />approval and this evening there are only three members present so all three member must vote for <br />approval. Any applicant wisliing to delay his request until the neart meeting, should do so at this time. <br />No one asked to have their request continued <br />1. Bennett/Dover Home Remodelers, Inc., 29341 Lorain Road. <br />Request for variance (1123.12). Request 14 foot variance to keep a fenced in storage area in the <br />required 15 foot rear landscaped buffer. ALso request a 4 foot side yard variance to oonstruct an <br />outdoor fire exit stairway in order to use the second floor for offices. Violation of Ord. 90-125, <br />Section 1139.07 (table). <br />Chainnan Gomersall called all interested parties before the board. The oath was a"stered to Mr. <br />Orr, Bennett/Dover, Councilmau Nashar, and Mr. Lynch. Mr. On explained that tliey had made the <br />dumpster enclosure smaller than originally planned because they needed as many parking spaces as <br />possible and then they added an enclosure behind it with a concrete deck to store some of the <br />equipment they use in their business. The neighbors on either side had written that they had no <br />objection. Mr. Lynch, a resident of Stearns Road, stated that he could see the entire back of this lot. <br />Mr. Nashar stated that the fence that surrounds the area, conforms to the other fence and he had no <br />objection. Mr. Gomersall agreed. Mr. Lynch had no problem either_ The members fias no objection to <br />the exterior fire exit stairway. J. Maloney moved to grant to Bennett/Dover Home Remodelers, Inc., <br />29341 Lorain Road, their request for a 14 foot variance to keep a fenced in storage area in the required <br />15 foot rear landscaped buffer and also their request for a 4 foot side yard variance to construct an <br />outdoor fire exit stairway in order to use the second floor for offices. Violation of Ord. 90-125, <br />Section 1139.07 (table). The motion was seconded by R. Gomersall, and unauimously approved. <br />Variances granted. <br />2. Thomas and Susan Hreha (New owners Mr. and Mrs. James Stallman), 5084 Luudale. <br />Request for variance (1123.12). Request variance to "place 6 foot stockade fence on side property line <br />which will extend down to the front property line. Violation of Ord. 90-125, Section 1135.02(f-1). <br />Chairmau Gomersall called all interested parties before the board. The oath was administered to Mrs. <br />? Hreha. Mr. Gomersall stated that he had one objection since cars would be exiting from the adjacent <br />commercial dxive and children on the sidewalk would not see them.
