, <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />1VIINiJTES - JIJNE 8, 1995 <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />Present: M. Boyle, T. Koberna, J. Maloney, W. Purper, and R. Gomersall. <br />Also Present: Law Director Gareau, Building Commissioner Conway, and <br />Clerk of Commissions Oring. <br />Chairman Gomersall advised all present that each case would be judged on the physical situation <br />peculiar to itselt so that in no way is a judgment rendered considered to be a general policy <br />judgment affecting properties and like situation elsewhere. <br />W. Purper moved to accept the minutes of May 4, 1995 as written, seconded by J. Maloney, and <br />unanimously approved. <br />J. Maloney moved to accept the minutes of the special meeting of May 15, 1995, seconded by T. <br />Koberna, and unauiinously approved. <br />l. _ Gary Cas&/ Stylin' Concepts, 29919 Lorain Road. <br />; Request for variance (1123.12). Request 10 foot front setback variance to construct new building. <br />Violation of Ord. 90-125, Section 1139.07. Also request special permit to add to existing non- <br />conforming building. Special permit required Ord. 90-125, Section 1165.02(b)(1). <br />Chairman Gomersall called all interested parties before the board. The oath was adiniuistered to <br />Mr. Case, owner, and Mr. Benedict, a neighbor who lives to the rear. Mr. Gomersall noted that the <br />Plauviug Commission recommended approval. Mr. Case stated that since his neighbor was <br />concemed about buffering, he had a revised plan which included some scotch pines for screening <br />and he also was showing the lighting in the rear which has a low spill rate and would be on a timer <br />which will turn them off after his employees leave. Building Commissioner Conway advised that <br />both of these issues should be addressed by the planning commission, the function of this board <br />was to deal with the variances. Mr. Benedict stated that he had no problem with the variances, his <br />concern was the buffering in the rear property line. Law Director Gareau pointed out that <br />previously the city required a 50 foot front setback and since it was changed to 75 feet practically <br />anyone developing on Lorain Road needs a variance. He noted that changing it to 75 feet, just <br />moves developments closer to residential areas. He suggested a floating setback that planning <br />commission could deal with such as from 35 feet to 70 feet depending on how much. green area <br />there would be in front. Mr. Case explained that he needed the variance to keep this building in <br />line with his existing building. He also noted that he was going to have to cut away some of his <br />parking area to comply with the 20 foot setback. The members had no problem with the proposal. <br />J. Maloney moved to grant to Gary Case, STylin' Concepts, 29919 Lorain Road, his request for a <br />10 foot front setback variance to construct new building. Violation of Ord. 90-125, Section <br />1139.07. Also to grant a special permit to add to existing non-conforming building. Special permit <br />required Ord. 90-125, Section 1165.02(b)(1). The motion was seconded by W. Purper, and <br />unanimously approved. Variance and special permit granted. <br />2. Charter One Bank, 25290 Lorain Rd. <br />Request for variance (1123.12). Request variance to hang temporary banner underneath overhang <br />of building. Violation of Ord. 90-125, Section 1163.12(g).
