These changes should improve some of the flooding problems that persist in <br />North Olmsted. He advised Mr. Manning that it would not matter if there were basements or not, the <br />retention would be sized the same. He explained that they have been working with the Engineering <br />Department over a period of months. Mr. Bedora, a resident, is concerned how the heavy equipment <br />will be brought into the property for construction, since Clague Road is being torn up. He wondered if <br />their streets would be able to handle that traffic. His street, Woodview Drive, has been in bad condition <br />for some time, and the city finally black-topped the street right up to the middle of his house, leaving the <br />road in front of his house and two others homes without the blacktop. He is also concerned about the <br />traffic from 55 homes coming out of Sharon Drive to Woodview and would like a traffic study to see if <br />a light should be installed. He noted that with the construction equipment on Clague Road, drivers <br />cannot see when they are riurning out of Sharon. Mr. Wachowiak claimed that the Whitlatch developers <br />had promised to cover the ditch in his back yard, but this is not shown on these plans and he will have <br />water discharging right at the back of his property. He is concerned because standing water creates a <br />mosquito problem. That is another promise made by Whitlatch that was not kept. Mr. Sheehe did not <br />know if it was ever their intent to work beyond their property lines. He clarified that the retention pond <br />will reduce the velocity that go through the creek aud will improve the point of discharge. He cannot <br />speak to issues of doing work on someone else's property. Ms. Deucher, a resident, wondered about <br />the chain of events, since the retention system is not built, but there is a wall up on the commercial <br />property in front. Since the city is not dealing with the original developer, how do they know there will <br />be a surety bond on deposit with the city, and will the original promises be kept. Right now she has a <br />wash with a chain link fence next to her property which is seldom cleaned out or maintained, since the <br />city did not have enough help. Recently one person did clear it out and left the debris that was cut out; <br />that debris then flowed down to Mr. Wachowiak's property and caught in the drain. She stated that they <br />wanted to deal with these problems ahead of time, not after the fact. She would like the construction <br />equipment brought in from Lorain Road in order not to impact the streets that were rebuilt and the <br />neighbors who live there now. Mr. Spaulding believed that Mr. Margevicius brouglat up some points <br />that should be reviewed even if it takes a little more time. He asked if there was any assurance that the <br />previous commitments would be abided by. Mr. Bedora, a neighbor, was advised that some of the trees <br />on the area that is to be re-graded must be removed, there will be a buffer on the west end that will <br />remain. Mr. Belsito advised that, when the trees were being removed, he had a lot of cracks in his <br />plaster and is concerned that construction equipment will cause more problems. He, too, would like <br />some kind of access through the commercial property. He asked what kind of landscaping was being <br />required around the retention basin. Mr. Sheehe explained that once the grading is done, it will be <br />seeded and the city will be maintaining it. Mr. Herbster believed that the developer had agreed to take <br />responsibility for five years from when the building starts to make sure it was possible to maintain it. <br />Mr. Deichmann advised that the basin will be deeded to the city, but there will be a maintenance bond <br />on it. Mr. Belsito also was concerned about traffic from Sharon to Clague. Mr. Manning believed that <br />most people will be going out W. 231, but he agreed that there is a problem with traffic. Mr. Sheehe <br />advised Mr. Herbster that the equipment will come in on the existing right of ways and there is no way <br />they can use the commercial property. Mr. Manuing believed that they would have to remove the logs <br />by semi trailers and questioned if they would take care of the roads that are damaged. Mr. Sheehe stated <br />that these roads had heavy equipment on them when they were built, and he did not know that there <br />would be that much additional traffic for hauling on them. The city could enforce keeping the mud off <br />the streets. Mr. Brenuan stated that both the neighbors and the commission had been lied to by Mr. <br />Whitlatch who promised that construction traffic would come off Lorain Road. Mr. Sheehe stated that <br />when Whitlatch came in originally with a commercial site and cluster homes, one of his selling points <br />6
