<br />Mr. Porter presented the request. It was clarified that they are trying to add 3 more spaces, not one as <br />stated, but one of them would be in the front setback: He explained that they have 6 spaces and they <br />need 9 because they have more employees. There is uo room to add more paiking in the back and there <br />is also a problem with truck traffic in the back. Even though their trucks are out for part of the day, they <br />do come into the shop frequently for.parts, eta There is a retention system installed under the parking <br />lot at present. There will be curbs installed with the new parking. As?istant Building Commissioner <br />Rymarczyk advised that there would ouly be room for two parking spaces. The inembers studied the <br />plans. Chairman Tallon wondered if one space would be acceptable. He calculated that they could have <br />two spaces and have a 7 foot landscape buffer. He started to make a motiou when Assistant Law <br />Director Dubelko commented that tlus is the first time that he can reinember that a persou who has a <br />conforming green area has asked to have it reduced and, fiom the Law Department's view point, there <br />is a concern that, if the board of zoning appeals grants the variance, there could be a problem in court if <br />a similar situation arose. Mr. Rymarczyk stated that the greeu area is non-conforming now since it was <br />approved under the old code aud they had tried angle parking, but it did uot work out. It was pointed <br />out that once he changed his parking, he would be required to have a 20 foot laudscape buffer, instead <br />of the 17 feet that he had. After some discussiou, it was decided that he could have one space which <br />would only require a one foot variance from the original 15 foot setback aud by using the 8 foot in the <br />front of the building. <br />R. Tallon moved to recommeud to the board of zoning appeals that L. K. Heating & Cooling, 4891 <br />Dover Center Road, be granted one additional parking space by taking the 8 feet adjaceut to the <br />bu.ilding plus one foot of the shaded area on the plan and re-striping the parking lot, in order to have a <br />total of seven.parking spaces in that area, aud still retaiuiug 16 feet of laudscaping. The motiou was <br />seconded by K. O'Rourke, aud uuaniinously approved. <br />N. NEW DEVELOPMENTS AND SUBDNISIONS: <br />1) Vienna Woods Lot Split. <br />The proposal is to subdivide permanent parcel No. 231-27-03 wluch fronts ou Lorain Road, into two (2) <br />parcels. Proposed Sublot `B", wluch will remain fionting on Lorain Road, is split-zoned: inostly Retail, <br />Business, General, but having a"C" Residence, Single, strip at the north (rear) portion. Proposed <br />Sublot "A" is zoned "C" Residence, Siugle Entirely. Both proposed sublots couform to zoning code <br />requirements for area and frontage. <br />Mr. Lambros, attorney, introduced theu engiueer, Stuart Saylor, who explained that there was uo way <br />that they could get an extra lot out of the extra resideutial laud that they uow show joiued to the <br />commercial properiy. Tlie only way tljey could use that portion of the residential land would be to <br />extend the lots on the cul-de-sac. Mr. Lainbros explained that they prefen•ed not to increase the length <br />of the sublots on the south because they would abut the commercial property on the back and the U- <br />Store-It on the side. 11iey .would prefer to keep tlus land as a buffer between their residential and <br />commercial lots and they are willing to have a deed restrictiou that they will not use tlus laud <br />commercially. He saw notlung in the code that prolubited having split zoned lots and he was sure there <br />were others in the city. Mr. Tallou advised that the city has been trying to correct tlus situation <br />whenever one comes before the board. Mr. Lambros believed that the deed restrictiou would correct <br />the problem and they prefer not to have someone abutting their commercial property. Assistant Law <br />Director Dubelko advised that the city would prefer to have the lots split at the zoue line, but the Law <br />Director thought that the city would be protected if the property remained split zoned but was <br />5
