.? <br />Mr. Lambros, attorney for the developer, presented the proposal. Assistant Law Director Dubelko <br />advised that he had received a copy of their restrictive covenant deed which is not done the way he <br />would have done it, however, he believed that Mr. Lambros has enough experience that it should uot be <br />a problem. He will have the Law Director approve it when he comes back froin vacation, aud would <br />recommend that the commission approve the lot split; contingent upon the covenwt being in a final <br />form acceptable to the Law Department. R. Tallon moved to approve the Vienna Woods Lot Split <br />proposal is to subdivide permanent parcel No. 231-27-03 which fronts -bn °Lorain Road, into two (2) <br />parcels. Proposed Sublot `B", which will remain fronting on Lorain Road, is split-zoned: mostly Retail, <br />Business, General, but having a"C" Residence, Single,, strip at the north (rear) portion. I'roposed <br />Sublot "A" is zoned "C" Residence, Single Entirely. Both proposed sublots couform to zoning code <br />requirements for area and frontage subject to the approval of the deed restriction by the Law <br />Department. The motion was seconded by K O'Rourke, and unanimously approved. <br />2) Downing Conpany lot split and assembly plat. <br />The proposal is to split perinauent parcel number 231-33-016 (Long John Silver site) and join the rear <br />(uorth) portion to permanent parcel number 231-33-026 (site of the proposed La-Z-Boy furniture) <br />which abuts. Location is the north east corner of Lorain and Root Roads. Zoning is Retail Business, <br />General Entirely and required area variances have been obtained. <br />Tlus proposal was withdrawn by the arclutect. <br />V. COMMUNICATIONS: <br />No items. <br />VI. COMMITTEE REPORTS: <br />Mr. Tallon advised that Assistant Law Director Dubelko, Building Couzmissioner Conway, and he <br />will be drafting a letter eaplauung the suggestious that were made by the zoning code committee. <br />VII. MINOR CHANGES: <br />Chairman Tallon explained the minor chauges, both of which are for lighting. Baker's Square would <br />like to install new poles 22 feet lugh with 2000 watt fixtures. Burger King would like to install 24 foot <br />poles with 1000 watt fUCtures (which is up fiom 400 watts). Mr. Tallon explained that Burger King's <br />photometrics went up to a maximum 31 foot candles with a miniinum of 2.5 foot candles on the <br />property line. The members agreed that this was entirely too bright, especially since both of these <br />businesses were adjacent to either homes oi• condominiums. Both requests were denied as minor <br />change, if they wish to, they may come before the board with their proposal. <br />VIII. NEW BUSINESS: <br />No items. <br />IX.
