He <br />noted there is a provision in the zoning code that provides that it is permissible to build on a non- <br />conforming lot, and explained that you cannot have a variance for an existing lot. Mr. Gomersall <br />reiterated that he did not understand the first note. It was noted the only variance needed is for the <br />side yard, and the note is meant to clarify that point. Mr. Gareau restated, there is a provision in the <br />zoning code which states that if a lot is non-conforming, but all other requirements. are met, <br />variances are not required. Mr. Gomersall clarified only one variance is required. A resident <br />wondered if the proposed new dwelling will be four foot off the property line. Mr. Purper clarified <br />that code requires a minimuni of 15 feet of total side yards: Mr. Fox's proposal includes 11 feet of <br />total side yards, which is his reason for seeking a 4 foot variance. Another resident questioned if <br />there is a requirement for width of lots iu class A and B on Barton Road. Much of the discussiou <br />was inaudible as several people were talkiug at the same time. Mr. Gareau clarified that tlus is a <br />buildable lot. W. Maloney stated the proposal is 150 feet back from the street which is permissible <br />by code. Mr. Gareau explained the last time the zoning code changed the setback requirement was <br />changed, as at one time a variance would have been required if a home were more than 75 feet back <br />from the street. Mr. Campbell wondered what the use is for a building code as nothing conforms to <br />it. Ms. Boyle responded that this proposal complies with building code. Mr. Campbell believed the <br />proposal encroaches on his property on the north and Mr. Schmelter's properly on the south. Mr. <br />Gomersall explained these variances are very minor, as he could build between the two neighboring <br />residents and still conform to all provisions in the zoning code. He believed, by going 80 feet behind <br />the neighboring properties, it is less bothersome than building the home in line with the others. A <br />neighbor_ stated that he would like to build on the south side of his house and would like to know <br />how close he can come to maintain the 15 foot aggregate, if there is already 20 feet on the opposite <br />side. It was explained, any given resident can build 5 feet. off the property line, but one must <br />maintain 15 feet of total side yards, or a variance would be required. Mr. Fox's reasoning for <br />moving'the house back was to make the neighbors less cramped in, as he could conceivably build in <br />line with the iest of the homes and conform to all the provisions of the zoning code. Mr. Purper <br />suggested that the board vote on this proposal. <br />J. Maloney moved to grant the proposal of Chris Fox, sublot 1 Barton Road, North of 6115 Barton <br />Road. Request for variance (1123.12). <br />Request the following variances: A 4 foot variance for width of total side yards. <br />Violation of Ord. 90-125, Section's 1135.07 (a). The motion was seconded by R. Gomersall and <br />unanimously approved. Variance granted. . ' <br />In the framing of the motion, Law Director Gareau clarified the 10.865 foot variance for average <br />width of lot is not required, as this is a buildable lot. <br />5.
