«.--? <br />: <br />Request for variance (1123.12). Request a 5 foot front setback variance for sublot 4 and a 10 foot <br />front setback variance for sublot 5. Violation of Ord. 90-125, Section 1135.06(a). NOTE: <br />minimum lot frontage is 70 feet, and minimum square footage required is 10,850 (1135.05(a)(a). <br />Both lots were platted with 60, foot frontage and contain 8,400 square feet. <br />Chainnan Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Duulap and his daughter, bu.ilders; Mrs. Korinka and her daughter, owners of the lots; and neighbors <br />Mr. Britton, Mrs. Tolowitzki, Mr. Gomski, and Mr. Pulito. It was noted that some of the neighbors <br />were. for the next request and this hearing would be specifically for sublots 4 and 5. Mr. . Gomersall <br />clarified that the minimum frontage and square footage had been changed since the lots were <br />established. Mr. Dunlap presented elevations of the two homes explaining that a 50 foot front yard <br />and a 50 foot rear yard are requ.ired, which would only allow a 40 foot deep house. Since. the one <br />ranch home next to one lot has a 35 foot front set back and the house on the other side has a 50 foot <br />setback, he is proposing to stagger the setbacks for a more pleasing appearance. He would not have <br />to have a variance on sublot 4, but he believed that, aesthetically, it would be more pleasing. The <br />variances were explained to Mrs. Korinka. Mrs. Tolowitzki was interested in the next request. He <br />showed the elevations to Mr. Britton, who lives across the street, and who had no problem with this <br />request. J. Maloney moved to grant the request to Curt Dunlap, Sublots 4 and 5 Decker Road,. lots <br />located between 5976 and 5940 Decker Road, P.P. # 235-14-100 & 101, for a 5 foot front setback <br />variance for sublot 4, and 10 foot front setback variance for sublot 5. Violation of Ord. 90-125, <br />Section 1135.06(a). NOTE: miniinu.m lot frontage is 70 feet,,and miniinum square footage requ.ired <br />is 10,850 (1135.05(a)(a). Both lots were platted with 60 foot frontage and contain 8,400 square feet. <br />The motion was seconded by R. Gomersall, and unaniinously approved. Variances granted. <br />5. Curt Dunlap, Sublots 401 and 402 Decker, property located between 5963 and 6001 Decker Road. <br />P.P.# 235-14-74 & 75. <br />'Request for variance (1123.12). Sublot 401: Request 8 foot front setback variance; 2 foot total side <br />yard variances. Request 2 foot variance for distance between dwellings on both north and south side; <br />request 145 square foot variance for minimum livable floor area on first floor. Violations of Ord. 90- <br />125, Sections 1135.06(a); 1135.07(a) and 1135.03(b). Sublot 402: Request 8 foot front setback <br />variance; request 2 foot variance for total side yards; reqnest 2 foot variance for distance between <br />dwellings on north side; and request 145 square foot variance for minimum livable floor area on first <br />floor. Violations ofOrd. 90-125, Secrions 1135.06(a); 1135.07(a) and 1135.03(b). NOTE: <br />Minimum lot frontage required is 70 feet; minimum square foot area of lot required is 10,850 <br />(1135.05(a)(1). Both lots were platted with 40 foot frontage and contain 8,400 square foot. Both <br />proposals will be heard by the board of building code appeals on Thursday, February 22, 1996 for <br />review of drainage. <br />Chairman Gomersall called all interested parties before the board. The oath had been administered to <br />the developers and neighbors for the first request. Mr. Gomersall noted that he was aslang for 9 <br />variances on the two lots. Mr. Dunlap advised that he is asking for the setback variance to stagger the <br />setbacks between the adjacent houses. The house at 5963 is at a 40 foot setback and the house 6001 <br />Decker is at a 50 foot setback, and the next house at 6009 has a 45 foot setback. The house he is <br />planning to build is 8 feet deeper than what could be placed this lot. The rear yard will conform to the <br />50 foot requirement. Mr. Gomersall suggested that the house on s/1402 could be moved back to be <br />more in keeping with the house at 6001 which is at 50 feet. This would require a rear yard variance. <br />Mr. Dunlap clarified that he would be changing the front elevations of the two homes. Mr. Koberna <br />3
