.y <br />2. Glenn Limpert, 4282 Clague Road. <br />Request for variance (1123.12). Request variance to rent apartment (over garage) to a non- family <br />member. Violation ofOrd. 90-125, Section 1135.01. <br />Variance granted to use apartment for family member on August 2, 1972. <br />Chairmau Gomersall called all interested parties before the board. The oath was acimivistered to Mr. <br />Limpert, and neighbors Mr. Kall, Mr. and N1rs. Randles, Mr. Kivon, and Mr. Flood. It was clarified <br />that Mr. and Mrs. Randles live behind Mr. Limpert's property and Mr. Flood lives next door. Mr. <br />Limpert stated that the building had been there for 50 years and he had remodeled it so his son could <br />live there. Since he has moved away, they have allowed their family to use it when they visited from <br />out of town. Mr. Gomersall noted that now he was requesting to rent it out, not use it for family. Mr. <br />Limpert stated that lus brother lives there in the summer when he comes back from Florida. He <br />clarified that now he is allowing an employee to live there, and is requesting to rent it out in the <br />future. Mr. Kivron, a neighbor who lives two doors to the north, spoke in favor of the request <br />because Mr. Limpert was a good neighbor and frequently used the heavy equipment that he owns to <br />help out his neighbors, including offering to help Mr. Flood move a bridge that was over a creek. He <br />advised that a feuce and trees had been cut down on his property without his permission, and people <br />had left trash and debris there, but he has never complained. He believed that Mr. Limpert was a <br />good neighbor and was trying to help the girl who is living in the apartment. Mr. Krall objected to <br />having an apartment occupied by non-family members since this area is zoned for single family <br />homes. Mr. Randles agreed. Mr. Flood, who lives next door, advised that when he bought his <br />property, he investigated the zoning hearing mf 1972, and as he understood it, the apartment was an <br />extension of Mr. Limpert's prime residence, only for members of his family. He believes that it is <br />immaterial whether the nurse who is living there is paying rent or not. Mr. Gomersall, W. Maloney, <br />and Mr. Koberna agreed. T. Koberna moved to grant a request for Glen Limpert 4282 Clague Road, <br />for a variance to rent apartment (over garage) to a non-family member. Violation of Ord. 90-125, <br />Section 1135.0. The motion was seconded by R. Gomersall. Roll call on motion: Gomersall, <br />Maloney, and Koberna, no. Mr. Puiper abstained. Motion failed to pass. Variance denied. <br />Mr. Purper had arrived during the above hearing. <br />3. John & Jean Lieb, 6495 Cypress Drive. Request for variance (1123.12). Request 12 foot rear yard variance to construct an addition. <br />Violation of Ord. 90-125, Section 1138.08(a). Also request special permit to add to non-conforming <br />dwelling. Specialpermit required Ord. 90-125, Section 1165.02(b)(1). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />and Mrs. Lieb. The addition to the back of the house will be in the middle and will only be 6 feet <br />deep. The members had no problem with the request. R. Gomersall moved to grant to John & Jean <br />Lieb, 6495 Cypress Drive, their request for a 12 foot rear yard variance to construct an addition. <br />Violation of Ord. 90-125, Section 1138.08(a); and also to grant a special permit to add to a uon- <br />conforming dwelling. Special permit required Ord. 90-125, Section 1165.02(b)(1). The motion was <br />seconded by W. Purper, and unanimously approved.
