?-' <br /> <br />Mr. Gomersall questioned how that happened. Mr. Hammerschmidt esponded that he had subdivided <br />a two acre parcel from a huge piece of land. Assistant Building Co 'ssioner Rymarczyk stated that <br />he had split the parcel originally and now wants to put a building on-that is too large for the size and <br />coufiguration of the lot. Mr. Cerney responded that that the odd size of the lot was not created by the <br />owner. At this time, Chau7nau Gomersall admuustered the oath to Mr. Cerney, Mr. Hammerschmidt, <br />and Mr. Wagner, who represented the owner of the industrial park. The members thought that Mr. <br />Hammerschmidt had owned a larger lot aud had sold some, but Mr. Wager advised that this was <br />subdivided as a minimum two acre lot. Mr. Gomersall noted that there is strip parking in front of the <br />building. The developers pointed out that, because ofthe large cul-de-sac, the lot has several areas of <br />wasted space. Mr. Cerney presented a drawing showing how this building would fit on a normally <br />shaped, two acre parcel, without needing a variance. They have done some things on the building <br />which are more costly in order to conform to the shape of the lot. Since they have asked for a <br />reduction in the landscape buffer, they are planuing to add more landscaping than necessary to hide <br />the parked cars. He presented a landscaped plan showing mounding, trees, and a hedgerow in front <br />of the cars. The mound will be about 4 feet high. He stated that, according to the standards he uses, <br />these spaces will allow room for cars. They prefer not to put parking in the back, because there <br />would be large doors for in the tenants' spaces. Mr. Wagner stated that the cul-de-sac is about 180 <br />feet and normally it would be about 160 feet. Law Director Gareau advised that the city built the cul- <br />de-sac so the city is partially to blame for the shape of the lot. The members had no problem with the <br />proposal since it is in the industrial area and will not be visible to the general public. Mr. Cerney <br />clarified that there could be up to 8 units and each one would have a door in the back. T. Koberna <br />moved to grant the request of High Tech Pools, S/L 11 Industrial Park, for a 5 foot 6 inch variauce to <br />have parking encroaching in landscape buffer and a 9 inch variance for length of curb in a 45 degree <br />parking stall. Also to grant the 7 foot rear setback variauce at narrowest point for encroachment of <br />drive. The motion was seconded by R. Gomersall, and unanimously approved. Variances granted. <br />7. Gwen Hinckley, 24301 North Oxford Oval. <br />Request for variance (1123.12). Request 3 foot side yard variance to install air condition unit in 5 foot <br />side setback. Violation of Ord. 90-125, Section 1135.07. Note: this is also in violation of Sections <br />1355.03 and 1355.04 ofthe Building Codes. <br />Chainnau Gomersall called all interested parties before the board. The oath was administered to Mr. <br />and Mrs. Hinckley. Mr. Gomersall advised that if they get this variance the air conditioner will have <br />to be screened with shrubs. Mrs. Hinckley agreed and explained that the unit would have to be 3 feet <br />out from overhang if it were put in the back yard. The only neighbor affected would be the Karlonas, <br />who have no windows on that side of the house, but if it were in the back yard, it would be seen from <br />their glassed in porch. Because of illness in the Karlonas family, no one could attend, but they had no <br />problem with the request. W. Purper moved to grant a request for Gwen Hinckley, 24301 North <br />Oxford Oval, for a 3 foot side yard variance to install air condition unit in 5 foot side setback. <br />Violation of Ord. 90-125, Section 1135.07. Note: this is also in violation of Sections 1355.03 and <br />1355.04 of the Building Codes. The motion was seconded by T. Koberna, and unanimously approved. <br />Variance granted. <br />8. Shao-Lin Center for Martial Arts, 26406 Lorain Rd. <br />Request for variance (1123.12). Request 32 square foot variance to replace existing (Fred Astair) wall <br />sign on second floor of building. Violation of Ord. 90-125, Section 1163.12(a). Note: wall signs for <br />second floor businesses not covered in Zoning code and there is one vacant ground level tenant space. <br />5
