<br />Chairman Gomersall called all interested parties before the board. The oath was administered to F. <br />Versagi, owner, and C. Woost, sign contractor, who explained that they were just replacing the sign <br />faces in the same cabinet. Assistant Building Commissioner Rymarczyk amended the request since <br />recently an awuing, with their name on it, has been added which will increase the request by 4 square <br />feet. Also the unit downstairs is now occupied. Mr. Versagi stated that this was the same awning the <br />previous tenant had. J. Maloney moved to grant the request of Shao-Lin Center for Martial Arts, <br />26406 Lorain Road, for a 36 square foot variance to replace existing wall sign on second floor of <br />building. Violation of Oxd. 90-125, Section 1163.12(a). Note: wall signs for second floor businesses <br />not covered in Zoning Code. The motion was seconded by R. Gomersall, and unauunously approved. <br />Variance granted. <br />9. Seaman's Furniture, 24869 Lorain Road. <br />Request for variance (1123.12). Request special permit to add to non-conforming build.ing (8 foot <br />encroachment into front setback). Special permit required Ord. 90-125, Section 1165.02(b). <br />Chainnau Gomersall called all interested parties before the board. The oath was admivistered to Mr. <br />Baker, owner; Mr. Coyne, attorney; Mr. Mongello and Ms. Kemp-Kopco, architects; and neighbors, <br />Mr. and Mrs. Goldberg; Mr. Dublo, Ms. Mencke, Ms. Bruskotler, Ms. Kosmides, Mrs. Bajesi, Mr. and <br />Mrs. Steffan. Mr. Skoulis, representing the Park West Homeowners Association, was sworn in <br />separately. The oath was then administered to Ms. Kackloudis, Mrs. Bajesi, Mrs. I9iver, and Mr. <br />Crisler. Mr. Gomersall showed the neighbors the plans, and explained that there was a corner of the <br />building infriuges on the setback, making it non-conforming. The only thing the board will be <br />discussing is whether or not to grant a special permit to add to a non-conforming building. Any <br />comments must apply to that issue only. The board is not here to discuss planuing, mounding, or <br />anything of that nature. IVlr. Coyne explained that the part of the building involved is existing, but it is <br />not clear how or when it became non-conforming. The building encroaches about 8 feet and, at the <br />direction of the planning commission, they have changed that corner by adding a canopy. Mr. Baker <br />believed that this addressed what planning commission had wanted to enhance the building. Law <br />Director Gareau advised that the setback used to be 50 feet and the city changed it to 75 feet. Mr. <br />Skoulis noted that the planning commission had recommended that this board approve the special <br />permit with the stipulation that parking spaces be landbanked and mounding installed. Mr. Ciomersall <br />stated that mounding, landscaping, landbanked parking is up to planning commission and not up to <br />this board. Mr. Gareau advised that code had been changed so that planning commission was <br />authorized to landbank parking spaces. Mr. Skoulis explained that he and Mr. Baker have been <br />discussing the buffering, and he had suggested that the developers get together with the neighbors to <br />agree on the landscaping and mounding. Mr. Gomersall believed that the owner appeared to be <br />working with the people and also thought, that considering what could go in this area, a furniture store <br />would be better than many businesses, since there would uot be a mass of people coming in and out <br />late at night. Mr. Steffan responded that the neighbors are concerned since Seaman's has a history of <br />baukruptcy problems and, when Mr. Baker proposed an addition before the board earlier, they went <br />out of business a week later. Mr. Mongello advised that since planning had asked that something be <br />done to the building at the point, they have added some columns and a canopy which will extend about <br />3 or 4 more feet into the setback and asked if tlus would be considered part of the structure. A <br />variauce would be required for this along with the special permit. Mr. Steffan stated that this is why he <br />came to the meeting, he was concerned that changes would be made. He was advised that if they need <br />another variance, it would have to come back. Mr. Maloney noted that the canopy would be over the <br />sidewalk area, and it was not that much of an encroachment. T. Kobema moved to grant to Seaman's <br /> <br />6
