buses would have a problem getting down the street, ifpeople were parked in front of Mr. Elias' house. The neighbors do not want the additional traffic on a dead end street. It was noted that there were no dimensions given for the sign and there was no location shown.. Mr. Smith presented a petition signed by 5 neighbors objecting to the variance. Mr. Elias had been told previously that the neighbors were against the idea. The neighbors explained that Mr. Elias had been in an accident the day before, but they also think that he changed his mind about asking for the variance. R. Gomersall moved to grant to Tony Elias, 4919 Grace Road, a variance to sell produce in front yard in residential area; a variance to set up stand for sale of produce; and a variance to install sign indicating "Produce for Sale" iu residential district. Violation of Ord. 90-125, Sections 1135.02(b)(2), (5) and (7) and 1163.07. The motion was seconded by T. Kobema. Roll call on motion: Gomersall, Koberna, Boyle, Maloney, and Purper, no. Motion failed to pass. Variances denied. 13. Robert Vienna, 26112 Bvron Drive. Request for variance (1123.12). Request 55.2 square foot variance for area shed which will exceed the minimum 2% area ofthe rear yard which is permitted. Violation of Ord. 90-125, Section 1135.02(d-1). Chairman Gomersall called all interested parties before the board. The oath wa's administered to Mr. Vienna. The members had no problem with the request. W. Purper moved to grant the request of Robert Vienna, 26112 Byron Drive, for a 55.2 square foot variance for area shed which will exceed the minimum 2% area ofthe rear yard which is permitted. Violation of Ord. 90-125, Section 1135.02(d-1). The motion was seconded by W. Purper, and unauimously approved. Variance granted. 14. Frances Lakey, 5422 Kennedy Ridge Road. Request for variance (1123.12). Request 5 foot variance for distance between proposed detached garage ? and dwelling. Existing garage will be demolished. Violation of Ord. 90-125, 5ection 1135.02(c)(2). Chairmau Gomersall called all interested parties before the board. The oath was admiuistered to Ms. Lakey. Mr. Gomersall noted that she would have to put a fire wall on the portion that was only 10 foot from the porch. Ms. Lakey agreed. J. Maloney moved to grant the request of Frances Lakey, 5422 Kennedy Ridge Road, fova 5 foot variance for distance between proposed detached garage and dwelling with the condition that the fire wall be included. Existing garage will be demolished. Violation of Ord. 90-125, Section 1135.02(c)(2). The motion was seconded by R. Gomersall, and unanimously approved. 15. Tim and Donna Szczepinski. 23958 Elm Road. Request for variance (1123.12). Request 1 foot variance between proposed addition and detached garage. Violarion of Ord. 90-125, Section 1135.02(2). Note: Existing garage will be demolished and a new garage built in compliance within one year. Chairmau Gomersall called all interested parties before the board. The oath was administered to Mr. and Mrs. Szczepinski, Mr. Gomersall noted that they would have to bu.ild the new garage within one year. R. Gomersall moved to grant the request of Tim and Donna Szczepinski, 23958 Elm Road for a one foot variance between proposed addition and detached garage. Violation of Ord. 90-125, Section 1135.02(2). Note: Existing garage will be demolished and a new garage built in compliance within one year. The motion was seconded by W. Purper, and unanimously approved. Variance granted. 16. Gerald Chalkwater, 4199 Danberrv Drive. Request for variance (1123.12). Request 81.18 square foot variance for area of shed which exceeds the 2% maximum of the rear yard area. Also request 3 foot rear yard variance for location of shed which will replace and enlarge existing shed. Violation of Ord. 90-125, Section 1135_02(dl-4). 5
