Gomersall stated that it is not wise to build prior to approval, because <br />if it is denied the applicant will have to tear the structure down. <br />T. Kobeiiia inade a motion to grant the request for Raymond and Julie Klesta, 5907 Barton Rd., for a 410 <br />square foot size variance to build a detached garage wluch will be attached to the existing shed. Note: the <br />area of the shed plus garage exceeds the size of a detached garage as required by code. Violation of Ord. 90- <br />125, Section 1135.02 (o-l). The motion was seconded by M. Boyle and unanimously approved. Variance <br />granted. <br />3. William Berndsen, 24213 Gessner Road. <br />Request for variance (1123.12). Request 2 foot, 8 inch variance for distance between proposed addition and <br />detached garage. Violation of Ord. 90-125, Section 1135.02(c)(2). <br />Chau-man Gomersall called all interested paities before the board, the oath was admuustered to Mr. <br />Benderson, owner. Mr. Gomersall explained, because he is closer to the garage tlian is required by code, tlus <br />board will requue that a fire proof wall be iustalled on the corner that is closest and arouud the side of the <br />garage. Nir. Benderson agreed to adhere to Mr. Gomersall's request and it was clarified that the fire proof <br />wall would Ue along the side and arouud the corner. It was suggested that Mr. Benderson contact the <br />building departinent to find out exactly what grade fire wall he should use. <br />J. Maloney inotioned to graut the request of William Berndseu, 24213 Gessner Road, for a 2 foot, 8 inch <br />variance for distance between proposed addition and detached garage. Violation of Ord. 90-125, Sectiou <br />1135.02(c)(2). Approval will be contingent upou installation of a fire wall on the garage in compliance with <br />the building department requireinent. The motion was seconded by R. Gomersall and unauunously approved. <br />Variance granted. <br />4. Rayrnond Thomas Jr., 24001 Frank Street. <br />Request for variance (1123.12). Request special pei7nit to add a dormer to a non-confoi7ning dwelling (fiont <br />setback). Special permit requued Ord. 90-125, Sectiou 1165.02(b)(1). <br />Chaiimau Gomersall called all uiterested parties before the board, the oath was administered to Mr. Thomas. <br />Mr. Thomas explained he would like to install a doriner ou his non-conforming dwelling. Mr. Gomersall did <br />not see a problem with tlus proposal. <br />1Vh-. Gomersall made a inotion to graut the request of Rayinond Thomas Jr., 24001 Franlc Street, for a special <br />pennit to add a dormer to a non-couforming dwelling (fi-ont setback). Special permit required Ord. 90-125, <br />Section 1165.02(b)(1). The motion was seconded by T. Koberna and uuanimously approved. Variance and <br />special pei7nit granted. <br />5. Richard Moran, 4650 Dover Center. Road. <br />Request for variance (1123.12). Request variance to move a non-conforming building (garage is over 750 <br />square feet). Violation of Ord. 90-125, Section 1165.02(c). Note: variances for this detached garage were <br />` granted on 5/2/84 and 5/1/85 and a variance for au attached garage was granted ou 9/6/89. <br />Chairman Goinersall called all interested paities before the board, the oath was admiuistered to Richard <br />Moran, owner. Mr. Moran explained tlus was approved in 1989 and 1990 and they uever followed through <br />with the request. He clarrified that they are now goiug to approve it and had to come back before the board <br />because they waited too long. It was clarified that there are two driveways with a bam on the property. Mr. <br />Moran stated that the existing garage, as noted on the plan, is 24 by 48 and asked ifhe could expand it to 24 <br />2
