Maloney made a motion to grant the agreed inodified request of David Wheatley, 2871 Clague <br />Road, a for variance (1123.12): to grant a 2 foot height variance and a 33.5 foot location variance, to <br />iustall a 4_5 foot high shadow box fence in side and rear yard of corner lot abutting front setback of <br />the adjacent house. Violation of Ord. 90-125, Section 1135.02 (fl) and (f2). The amendments are as <br />follows: the fence shall be in line with_the corner of the house; six feet from the neighbors driveway; • <br />and 15 feet offthe sidewalk. The motion was seconded by M. Boyle and uuauimously approved. <br />Modified, agreed upon, variance grauted. <br />3) L.K Heating & Cooling, 4891 Dover Center Road. <br />Request for variance (1123.12). Request 12 foot variance for landscape buffer to enlarge non- <br />conforming parking area. (20 foot landscape buffer required). .Violation of Ord. 90-125, Section <br />1139.07. Referred by planning commission July 9, 1996. <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Ruby, representing the company. Mr. Gomersall explained that planning commission would like to <br />retain at least 16 feet of landscaping aud recommended that one additional parking space be granted by <br />taking the 8 feet adjacent to the building plus one foot of the shaded area on the plan and re-striping <br />the parking lot, iu order to have a total of seven parking spaces in that area. Mr. Ruby explained he <br />would like to use a 240 square foot open area for the additional parking spots. He stated that the <br />property next door has a two or three foot buffer and they are proposing a five foot landscaped buffer. <br />Mr. Maloney explained that some of these buildings were built prior to these requirements. Mr. Ruby <br />explained the parking has to be iucreased because there are not enough spaces to accommodate all 14 <br />employees. Nfr. Gomersall agreed, since people were parking on the grass, however the city would <br />like to retain as much green area as possible. Ms. Boyle is in agreement with the parking space in the <br />back, however, she preferred that as much greenery as possible should be preserved. In response,U <br />Ruby explained the length will be reduced but the landscaped buffer will be widened. He believed tha _ <br />this will actually be increase the greenery and beautify the area. Mr. Koberna would rather see the <br />parking increased than people parkuig ou the grass, but asked if the employees could stagger the <br />parking in the front by blocking each other in during the day. A key could be left in the office and <br />someone could move the vans as needed. In response, Mr. Ruby stated that most .of the vans are in <br />the back of the building. The board discussed the proposal, and came to a consensus that would <br />approve this proposal if Mr. Ruby agreed to reduce it to a 10 foot rather than a 12 foot variance. Mr. <br />Gomersall believed this would increase the greenery two feet yet still leave adequate room for the <br />parking. Mr. Ruby agreed to reduce the request two feet. <br />T. Kobema moved to* grant the modified agreed upon request of L.K. Heating & Cooling, 4891 Dover <br />Center Road. Request for variance (1123.12). To grant a 10 foot variance for landscape buffer to <br />enlarge non-conforming parking area_ (20 foot landscape buffer required). Violation of Ord. 90-125, <br />Section 1139.07. Referred by planning commission July 9, 1996. The motion was seconded by J. <br />Maloney and unanimously approved.
