Chesapeake Bagels 24950 Lorain Road. <br />Request for variance (1123.12). <br />Request a 33 foot variance to operate business activities iu the 75 foot fiout setback area. <br />Violation of Ord. 90-125, Section 1139.07 <br />Chaii7nan Gomersall called all interested parties before the board. The oath was adinuustered to Mr. <br />Doty, architect, and W. Hei7na.u, a resident. Mr. Doty explained the patio would only be 8 foot wide but <br />they need a 33 foot variance because the building was coustructed uuder the old code wluch requued a <br />50 foot fiont setback, and now a 75 foot setback is required. Mr. Herman, who lives to the rear of the <br />property, explained that this property had a water problem, because there is a French drain in the rear <br />and during heavy rains he gets water in ivs yard. Mr. Doty stated that on the old plan it showed pipes in <br />the ground. Mr. Hei7nau explained that there is a water barrier around the parking lot, but the property <br />extends 4 feet beyond that all around, aud since there is a difference in elevation there is a problem. The <br />French drain worked well at first, but now it has filled up and he is getting all this water in lus yard. He <br />explained that the French drain percolates, and is not connected to the retention. Mr. Doty will talk to <br />the owner aud will make any correction necessary. The members had no objection to the request. <br />J. Maloney moved to grant the request of Chesapeake Bagels, 24950 Loraiu Road, for a 33 foot <br />variauce to operate business activities in the 75 foot front setback area. Violation of Ord. 90-125, <br />Section 1139.07. The motion was seconded by T. Koberna, and unanimously approved. Variance <br />granted. <br />7. Eugene Shank 24932 Gessner Ave. <br />Request for variance (1123.12). Request an 8 foot, 8 inch front setback variance for front porch. <br />Violation of Ord. 90-125, Section 1135.06 (a). Also request special permit (1123.11) to add to a non- <br />conforming dwelling. Special permit required Ord. 90-125 Section 1165.02 (b-1). <br />Chainnan Gomersall called all interested parties before the board. The oath was adnunistered to Mr. <br />Shank. Mr. Shank thought that he had applied for a 4 foot variance. Assistant Building Commissioner <br />Rymarczyk advised that the original porch was only 46 feet so he needed a larger variance. The members <br />had no objection to the request. <br />T. Koberna moved to grant a variance to lEugene Shank, 24932 Gessner Avenue for an 8 foot, 8 inch <br />front setback variance for a front porch. Violation of Ord. 90-125, Section 1135.06 (a). Also to graut a <br />special permit (1123.11) to add to a nou-coraforming dwelling. Special permit required Ord. 90-125 <br />Section 1165.02 (b-1). The motion was seconded by R. Gomersall, and u.nanimously approved. Variance <br />and special permit granted. <br />8. The Blind FactorX, 4725 Great Northern Blvd. <br />Request for variance (1123.12). Request the following sign variances: <br />A 20.7 square foot variance for total area of signage. ' <br />A 4.3 foot variance for length of sign which is less than three feet from either party walL <br />Violation of Ord. 90-125, Sections 1163.04 (a) and 1163.11 (b). <br />4
