CTTY OF NORTH OLMSTED <br />BOARD OF BUII.,DING CODE APPEALS <br />MINUTES - FEBRUARY 22, 1996 <br />1. ROLL CALL: <br />Chairman Burk called the meeting to order at 7:42 p.m. <br />Present: R. Burk, J. Kazak, and D. Spoerke. <br />Absent: P. Engoglia and W. Piar <br />Also Present: Clerk of Commissions pring. <br />Building Commissioner Conway had talked with the members before the meeting, but <br />he left to attend another meeting. <br />U. REVIEW AND CORRECTIONS OF MIl4UTES: <br />J. Kazak moved to accept the minutes of September 28, 1995, seconded by D. Spoerke, and <br />unanimously approved. <br />III. COMMUNICATIONS: <br />No items. <br />IV. HEARINGS: <br />1) Tony Filippelli, 5783 Columbia Rd. <br />Nosings do not project 1 inch and riser variation exceeds 3/8 inch. Violations of Section R. 213. Also, <br />head room on stairway is less than miuimum required. Violation of Section R 213.1 of the CABO One <br />and Two Family Dwelling Code which requires a minimum of 6 foot, 8 inches. <br />Chairman Burk admiuistered the oath to Mr. Filippelli, owner, and Mr. Goss, contractor, who <br />explained that this adclition was added between two others, and since there was an existing roo? he <br />took the roof level as high as he could without tearing off the existing roo£ He needed to fir the 2 by 6 <br />foot rafters to have enough clearance to install the required R 30 insulation, and when he opened the <br />wall to build the stairs there was a concrete stem wall around the house so there was only a certain <br />amount of distance from the existing floor so he dropped the first step as low as possible to establish the <br />first step and he laid out the other steps according to code, but with the padding and carpeting there <br />was even less room. One step has a slightly different lip, but he believed that was a differerice in the <br />lumber. The members understood the problems. J. Kazak moved to accept the variance as requested <br />with the condition that a hand railing is installed on side, seconded by D. Spoerke, and u.nanimously <br />approved. • <br />2) Gurt Duulap, S/1401 and S/1402 Decker Road, lots located between 5963 and 6001 Decker. <br />Raquest permission to build houses on two 40 foot lots. Hearing required by Section 1305.05(b) to <br />ascertain that proposed. construction does not affect drainage of surface water or waste into or over adjoining property or into any public street. Please note: Engineering Department will review the site <br />plan for drainage. <br />Chairman Burk administered the oath to Mr. Dunlap, builder, and neighbors, Mr. Britton and Mrs. <br />Tolowitzki. Mr. Dunlap presented a revised site plan and explained that it showed the configuration of <br />the houses on the lot and the location of the sanitary and storm water retention is located in order to <br />handle the water run-off. Mrs. Tolowitzki stated that she is concerned about drainage, because.she is <br />concemed her basement will flood. She has other concerns about the homes, but wondered if they <br />should be addressed to board of zoning appeals. Mr. Kazak advised that the board had a letter from <br />Assistant City Engineer McDermott stating that the drainage can be done properly, the board only has <br />to take care of the lot situation since these lots are "grandfathered-in" and are narrower than the code
