R. Tallon moved to approve the Homestead Village Hote? located on the south side of Country Club <br />Blvd., east of the proposed Marriott Courtyard, north of I-480, and west of Columbia Road. <br />A revised proposal to construct hotel. The motion was to approve the plan as submitted with the <br />landscaping plans having been approved this afternoon. The motion was seconded by R Koeth and <br />unanimously approved. <br />2) Richard Moran, 4650 Dover Center Road. Request conditional use permit to use an existing dwelling, in a residential district, as a senior citizens' <br />group home. . <br />Referral to board of zoning appeals is required. <br />Mr. Moran, owner, explained the proposal is for an Adult Care Facility, as defined in the Ohio <br />Department of Health Statutes. The members reviewed Mr. Moran's written documentation concerning <br />the proposal. Mr. McIntire, attomey, quoted from the Ohio Administrative Code, "any residence, <br />facility, institutions, hotel, assisted living facility, or similar facility that provides accommodations and <br />supervision to three to sixteen unrelated adults, at least three of whom are provided personal care <br />services," is an Adu1t Care Facility. The owners' of the home would like to use the third floor of the <br />home to accommodate approximately nine adults capable of ambulating. The home is eactensively wired <br />with security and smoke alarm systems. The Oluo Department of Health mandates that the owners and <br />managers of the facility be certified and undergo extensive training. Mr. Tallon questioned if Mr. <br />Moran was aware tlus is a single family residence district. Mr. Moran advised, he is aware this area is <br />zoned single family residence, and intends to maintain this zonage. He explained, an adult care facility <br />does not include the following: a nursing home, rest home, or home for aging (O.RC. 3721.01); an <br />alcohol or drug addiction program (O.RC. 3793.01); a habilitation center (O.RC. 5111.041); and a <br />residential facility for the mentally ill license by the department of inental health (O.RC. 5119.22). Mr. <br />Moran noted, only four people currently live in tlus rather large facility. He asked that the board grant <br />this conditional use permit so that he may make better use out of the home. Mr. Brennan inquired <br />about the definition of ambulatory. Mr. Moran replied ambulatory citizens are people capable of <br />getting about and do not require walking assistance. Mr. Brennan stated there are three flights of steps, <br />and the facility is proposed to be used for senior citizens. W. Moran clarified the proposal is not for a <br />senior citizens' group home, but instead for an adult care facility. He elaborated, although this is not a <br />senior citizens' group home, they are not precluded from accepting senior citizens. Mrs. O'Rourke <br />requested a description of the typical client. Mr. Moran believed the typical client would be between <br />the ages of 45 and 65, and may have a minor disability. W. Moran described the home as a family <br />environment which could be considered an assisted living group home. He advised, by licensure, he is <br />precluded from providing nursing services. It was noted, the client may have a visiting nu.rse. Mrs. <br />O'Rourke questioned if a client would have any means of transportation. Mr. Moran explained their are <br />vehicles available to transport people, but there would be a limited amount of this activity. He was <br />familiar with this type of operation, as his mother operates an adult care facility in Westlake. Mr. <br />Brennan wondered if Mr. Moran and Ms. Schneider must accept anyone the state refers. Mr. McIntire <br />advised the owners' have complete control over accepting or rejecting any applicant. Mrs. O'Rourke <br />believed this is a nice home, but a poor business location. Mr. Moran noted that the home is set back <br />far from the street and sits on three acres of land. He believed it was important for tlie members to <br />understand that this facility cannot lie used for drug rehabilitation programs or criminals of that nature. <br />By location, Mrs. O'Rourke stated she meant that the street is very busy now, and this will only worsen <br />traffic problems. Mr. Moran advised there will be minimal traveling. He explained his mother's facility <br />averages about twice a month a visiting nurse and twice a month taking someone to a doctor. Mrs. <br />O'Rourke wondered if these sixteen clients would be allowed visitors. Mr. Moran explained they do not <br />intend to accommodate sixteen people.
