Mayor Boyle noted many reasons <br />for maintaining the industrial zoning as the drainage and buffer requirements are more stringent. <br />He, believed this zoning should remain light-industrial in accordance with the master plau. Mayor <br />Boyle explained the administratiou has voiced their concerns on the use of this property. He <br />advised tlus area is developing quickly as light-industrial and uoted Q-Panel, Harsax, Space Age, <br />and Fortney & Wygandt all fit iu with the use intended for this area. The Mayor believed, if tlus is <br />developed light industrial, there could be a cul-de-sac at Bradley Road to prevent cut tluough. <br />Assistant Law Director Dubellco advised the charter imposes an obligation on the planning <br />commission to act consistent with the master plan to the fullest extent.permitted by law. He <br />eaplained the master plan, as reviewed and approved by plauning commission, provides that the <br />area north of the C.E.I. right-of-way is favorable to single-family cluster or large lot. Mayor Boyle <br />explained when a street is uon-dedicated the city is not responsible for the maintenance. Many of <br />the residents living in tlus area are not advised that the streets are non-dedicated which prompts <br />them to file a complaint with the city, even though the city is not responsible for the maintenance <br />of the streets. Mayor Boyle maintained tlus area is best suited for liglit-industrial_ Mrs. O'Rourke <br />questioned why the streets cannot be dedicated. Mr. Kaneriff explained the width of the streets <br />would have to be larger and the setbacks greater in order for the streets to be dedicated. He <br />believed it would be more of a single family residence district if the streets are dedicated. Nli-. <br />Kaneriffpointed out the optioned and exchange properties to Mrs. Zajak, a neighboring property <br />owner. The members discussed the proposal among themselves. Mr. Bird advised his back yard <br />abuts tlus property and raising the laud will worsen the flooding couditious. He also believed Mr. <br />Kanerifr s figures were incorrect as it appears he lias proposed 5.5 houses per acre of land. <br />T. Herbster made a motion on the Twin Lakes Estates, property Iocated between Lorain and <br />Bradley Rds., West of Timber Trails Subdivision. Proposal to construct Single Family Cluster <br />Developmeut. Rezoning will be required. Mr. Herbster motioned to recommend denial of the <br />proposal, because there is to many problems with the development, it goes agaiust the zoning in <br />place, and is not a benefit to the community. Assistant Law Director Dubellco interrupted the <br />motion, quoting from 1136.13 of the code and noted planning commissiou is supposed to review <br />it for compliance with chapter 1136 and give detailed fuidings to council. The commission is not <br />supposed to make a recominendation on rezoning, but should review the proposal and decide if it <br />meets the requirements for a cluster district. T. Herbster amended the motion to reflect the <br />following reasons for the recorrunendations: there is not common area to be enjoyed by the <br />occupants; there is not a recreational area, walkways, gardens or clubhouses; the setbacks do not <br />meet the zouing in the Lorain Road area; there is a question as to whether the livable space <br />proposed meets code and we need a definition of total usable area and if the easemeut is iucluded <br />in the 30 acres to make a determinatiou; and a problem with draiuage. Acting Chau-man Maniiiug <br />added to the inotion that the raising of the property is a problein as tlus is a flood area; having <br />fainilies, even though there was a report froin December of 1996, an article was presented stating <br />there was no problem with the C.E.I. lugh tension areas as there is just as inuch to dispute those <br />facts and fuidings that they do cause a danger and cancer; the use of the area as far as the residents <br />of the city of north olinsted is best suited for industrial as it is zoned; even though the developer <br />states there are "4.2 homes per acre", he does not take into consideration the C.E.I. lugh tension <br />liues which notlung can be built their aud used anyway; the area is over built; the buildings are not <br />of a cominon arclutectural form aud desigu; and the area is zoued and has beeu zoued light <br />iudustrial. The motion was seconded by T. Breunan and uuauimously approved. • Planuing <br />commission recommends that council deny tlus proposal.
