Mr. Fletcher thought that it was unrealistic to keep both doors closed, and <br />wondered if they were going to make A. & K Tire close all their doors and windows. Mr. Herbster <br />stated that A. & K. is there and there is nothing that can be done, but he did not want to add to thf <br />noise problem. He has no problem with the business, just the noise. Mr. Fletcher believed that the noisc, <br />coming out ofthe back door would travel west, not north toward the Porter Road residents. Mr. Tallon <br />asked that he screen the waste oil tank with a 6 foot fence to the end of the property line. Mr. Fletcher <br />explained that the cars would be vented from the tail pipe out the wall or window. Mr. Rymarczyk <br />stated that this is acceptable. He further advised that the sign would meet code. Mr. Brennan asked that <br />there be a timer on the sign so that it went off when they were not open for business. NYr. Fletcher <br />advised that they worked from 7:00 a.m. to 5:00 or 5:30 p.m. and he preferred to keep it on after hours <br />for advertising, but that would be negotiable. He further advised that he could not get a schedule for the <br />oil removal yet, because he had no approvals. He assumed that they would remove it during normal <br />business hours. No additional lights will be added, and the building will remain the same, but they might <br />change the trim on the windows. Mr. Carl Halleen, owner of the property, advised that he had talked <br />with Mr. Beebe and his wife, tlie next door ueighbors, who stated that they had no problems with A. & <br />K. and never had any problems Ziebart, and do not foresee any problems with this proposal. He advised <br />that the Beebe's property is zoned commercial, not residential. Mr. Trapp, 5182 Porter Road, advised <br />that he lives three houses away from this properly. He had several questions, and wondered if there had <br />been any notification given to the neighbors in the area. He was advised that notification was given to <br />the adjacent property owners who touch the property and those across the street according to the <br />ordinauce. He wondered who was looking out for the residents. He questioned where the plans and <br />environmental impact issues that should be addressed in terms of secondary containment, storage of <br />hazardous materials, storm sewers, and other issues that should be review under the Oluo Basic <br />Building Code and wondered if this was the body that would look into these issues since he has seen <br />nothing on this and it sounds like it is a completed deal. He stated that chemical plants that operate 'v <br />municipalities have a legal responsibility to uotify residents as to what is going on in their midst. He has <br />not been notified of anytlung pertaining to tlus. He does not know what is going on in this building, he <br />has heard several things, such as oil change, auto repair, aud he heard something about water repair in <br />the beginuing of the meeting and has no idea of what this is. What industrial processes going on here, is <br />there a description of it. Does the board have a description. Does this board submit plans, industrial <br />process descriptions, to a plans reviewer who reviews plans in the light of the Ohio Basic Building <br />Code. Mr. Brennan responded that the Building Department reviews every proposal under the O.B.B.C. <br />and as far as safety issues are concemed, the commission sent out their concerns to the Fire Department <br />and other safety forces after the last meeting regarding combustibles, other kinds of hazardous <br />materials, and they are following State mandated codes. The commission does not pass judgment on <br />that, they merely reviewed the application for the business to be there. Mr. Trapp stated he did not <br />know who reviewed this, but if it is the Builduig Department then that is where the information will be. <br />Mr. Breunan stated that it is not just the Building Department it is all the departments working together, <br />including this body, to see that lus property is protected. Mr. Fletcher advised Mr. Trapp that this is a <br />start up business. Mr. Trapp wondered if the Beebe property was the last commercial property ou <br />Porter Road. Mr. Rymarczyk advised that that it had not been verified that the Beebe property was <br />zoned commercial. Mr. Trapp asked if residents would be given access to the IVISDS sheets. Mr. Tallon <br />advised that the commission did uot review MSDS sheets. Mr. Trapp asked if he were a resident of <br />North Olmsted aud if he cared about his community aud asked why he had not reviewed them as a <br />resident, not as a representative of the city. Mr. Rymarczyk advised that these have been reviewed by <br />the Fire Department to be in coinpliance with their recommendations by the M.F.D.A. Mr. Brennai- <br />stated almost every product has a MSDS sheet'and it is up to the Safety aud Building Departments ani <br />they have done it.
