Mr. Trapp asked what the use group <br />classification according to the Ohio Basic Building Code. Mr. Tallon believed it was R. Mr. Rymarczyk <br />advised that it would be S-1. Mr. Trapp asked why not H, and wondered ifthey were making this up. <br />Mr. Tallon suggested that he could go to the Building Department in City Hall and ask what these plans <br />were reviewed under and they will give all the answers under the Ohio Basic Building Code. Mr. Trapp <br />asked if the Building Department would have a descriptiou of the industrial process that is going on in <br />this building. He clarified that an operation had to submit a description of the industrial activity that is <br />going on, they have to describe the industrial process which has to be reviewed by the plans reviewer <br />for the Ohio Basic Building Code, and he would like to see a description of the process that is going on <br />and if tlus board does not have this information, he will go elsewhere, since apparently the people on the <br />board are taking, someone else's recommendation as to what is going on in this building. Mr. <br />Rymarczyk explained that the proposal consists of a conditional use to do auto repair, as far as the <br />building itself, it is an existing site, and the previous use was an S-1 and this use group will be an S-1, <br />there is no change in use as far as the O.B.B.C. is coucerned. Mr. Trapp asked if the city had done a <br />study on the secondary contaiument for the area. Mr. Rymarczyk advised that they had uot. Mr. Trapp <br />asked what types of materials were going to be stored in the building, and in what types of contaiuers. <br />Mr. Rymarczyk advised that tlus information is in the material safety data sheets, and most of the <br />materials are pre-packed and kept in the containers that they are shipped in until they are used. In <br />response to other questions by Mr. Trapp, Mr. Rymarczyk advised that their would be a waste oil <br />storage tauk outside of the building, and the Fire Department would have to advise if there was <br />secondary containlnent. Mr. Fletcher explained that this would be a double wall tank. Mr. Tallon <br />advised that planning commission would recommend to council who would give the final approval. Mr. <br />Stulock, 5162 Porter Road, had several concerns: one would be the noise level and he could not believe <br />that the noise would travel right out the back; he believed that the parking would be a problem with <br />customers parking on the berm of Porter Road since Porter is heavily traveled and does not need <br />additional traffic. Mrs. O'Rourke explained that customers would have the option of using a Lorain <br />Road access. He also believed that tlus would not be concemed about keeping the cars in the front. He <br />would like tlus property re-zoned to residential, since most of Porter Itoad is residential. Mrs. O'Rourke <br />explained that this would have to be done by the owner, and Mr. Brennan stated that this was used as an <br />automobile sales room years ago and had been commercial for years. As far as his concerns about <br />parking, noise, light, and waste storage, most of these tlungs will be addressed in the motion. The <br />commission has requested noise panels, they have requested screening for the waste storage area even <br />though the next door property is zoned commercial; and the commission,does not want the cars in the <br />fiout. Mr. Stulock stated that this is a franchise operation and there is a shop on Pearl Road, and it does <br />have many vehicles parked in the lot. Tlus is a major concem of his, since lus boys ride their bikes up <br />there and tuim around in the parking lot, and this will cause considerable traffic which they do not need. <br />He was advised that the only sigu would be on the building. He objected because more people were not <br />notified and would like auother meeting where all the residents of Porter Road were notified. Mr. Tallon <br />explain.ed that by ordinance, they are only allowed to notify the adjacent property owners and the <br />property owuers across the street and they have to stick to the ordinance. Mr. Trapp, speaking from the <br />audience, asked if they were looking out for the people. Mr. Tallon asked how far should they go, and <br />there would have to be a cut off some place. Council set up the ordinauce, and hopefully ueighbors <br />would tell other neighbors about the proposal. Whenever there is a controversial proposal there is uever <br />a problem filliug the chambers, there has to be a cut-o$' somewhere. <br />R Tallon moved to approve the request for a conditional use permit to do auto repair for All Tune & <br />Lube (Old Ziebart Location), 5242 Porter Road with the conditions that the cement pad and waste oil <br />3
