going to hurt anyone. Mr. Brennan stated that there are things that affect people's quality of life and <br />property values, and that is what they are trying to address. Mr. Brooks explained that they are new at <br />this and did not follow all of the channels that they should have. He agreed that placing the field tha <br />close to other's property was a big mistake, and he apologized for that. If tuniing the field in another <br />direction will help, they will do it, and they will work with the neighbors. Mr. Brennan asked if it could <br />go over near the school yard, but Mr. Brooks believed that this would be too small an area, and the land <br />had a roll to it. It would be faster and less expensive to install it here. Mr. Tallon advised that this <br />proposal should have been listed as a conditional use permit, so that is they way this will be addressed. <br />He advised the developers that everything would have to be at least 100 feet away from the property <br />line, nothing can be closer, fences, benches, back stops, nothing. The port-a-potty is a good idea but it <br />must be secured and ludden as best as possible, perhaps putting it in the tree line and chaining it to a <br />tree. He advised that they must get some water down there, not 300 foot of liose, because no one would <br />ever do it. They should address all those questions, lay the diamond out, and bring it back to the <br />commissiou. Mr. Brooks asked if the residents would prefer to have the outfields in their back yards. <br />Mrs. Koziol was not sure, she would have to see it laid out on the field. Mr: Tallon stated that the <br />further they get it away from the residents, the better. Mr. Herbster suggested that Mr. Brooks have the <br />field drawn out on the properiy and have the residents see how it would look. Assistant Building <br />Commissioner Rymarczyk advised that he should have a plan drawn to scale since there was no one on <br />his staff to design it. Mr. Koeth suggested that he work with the school board since they should have a <br />layout of the property. After some d.iscussion, it was determined that there would not be enough time <br />for them to come back to the next meeting, and still get their approvals from council , prior to the <br />opening of the season. It was decided that the commission would refer this on to bzd with their <br />recommendations, and request that the chairman of the bzd hear it on April 14th providing that they can <br />have their drawings done by that time. They can as long as the school board does not have to re• <br />approve the plans if the diamond is relocated. Mr. Tallon again explained the provisions of approval o: <br />the conditional use permit, if they change the plan and turn it the other way, the commission will <br />approve it on the condition of approval of the bzd so they will not have to return to the commission. <br />R Tallon moved to grant a conditional use permit to construct a baseball diamond on the site of Birch <br />School on the drawing that was presented this evening with the with condition that everythiug be <br />moved 100 feet away from the property lines; the port-a-potty be secluded, screened, and secured; and <br />water will be brought to the field area. This permit will be conditional based on tlie approval of the bzd <br />because of the possibility of the changing of the diamond away from the residential area over toward the <br />parking lot, if the bzd agrees that will be a better site that will be satisfactory for the conditional use <br />permit, if not they would have to refer back to this plan and go with the 100 foot stipulation. As part of <br />this motion, it is suggested that they lay this out for the residents to see. The motion was seconded by <br />T. Brennan, and unanimously approved. <br />During the framing of the motion, Mrs. Koziol was advised to check with the Hot Stove Organization <br />regarding the liability insurance. Prior to the vote Mr. Osiecki ask if the developers would be required to <br />return and show the layout of the field. He was advised that this would be presented at the bzd meeting, <br />but it was recommended that they draw it out on the property. The residents were. advised that bzd <br />would be held on April 14th. Mr. Osiecki asked if this could be relocated to Pine School which has a <br />bigger field, but Mr. Murphy stated that they had looked at that and this is the best location in the city. <br />Pine has more water then even that at Birch. Mr. Brooks advised that they would try to re-locate the <br />field on Birch, but Mr. Murphy was concerned about the safety issues.
