L/ <br />on West 232nd Street, suggested increasing the parldng on the front ofthe building and removing <br />the proposed parldng to the rear. Mr. Kapostasy, a Mildred Avenue resident, had concerns about <br />the debris backing up the creek. Mr. Davis, a Mildred Avenue resident, questioned if Manor Care <br />will be using the Mildred Avenue sanitary system. Mr. Bu.rk advised the Lorain Road sanitary <br />system would be used. Mr. Davis believed headlights from cars pulling into the parking lot will be <br />a burden on residents immediately abutting the proposal, and wondered if there were hidden plans <br />to include access onto Mildred Avenue. He did not like the idea of a fence along the property line <br />because it blocks the view of the woods and he wondered if delivery hours would be restricted. <br />Mrs. Scott advised the main entrance in the front of the property would be used for the <br />ambulances and they would not be using the rear newly paved area for the ambulances. Mr. Burk <br />stated he would be willing to give the city a one foot strip of land, on the east side of the proposal, <br />in order to assure residents there would not be a cut through to Mildred Avenue. Assistant Law <br />Director Dubelko advised if the commission grants a conditional use permit for this proposal, they <br />can indicate as a condition that no access will be permitted onto Mildred Avenue. Mr. Brennan <br />wondered if the dumpster pickup can be restricted to a certain time. Mrs. Scott advised the <br />dumpster pickup comes after 8:00 in the morning, however the residents were concerned about the <br />delivery trucks. Mr. Brennan wondered if there was an ordinance in effect for deliveries. Mr. <br />Conway advised there are restricted hours for deliveries. Mr. Brennan recommended that the <br />residents contact their councilman and ask him to enforce the ordinance as far as delivery hours. <br />Mrs. O'Rourke questioned where the dumpster would be relocated. Mr. Burk advised the <br />dumpster would be moved to the western end ofthe property and south ofthe new parldng lot. <br />Mr. Bartko asked the administrator what time the late shift ends. Mrs. Scott noted there is a <br />change of shift at 11:00 P.M., which is something the residents opposed. Mr. Baker questioned if <br />this is a waste of time, as the zoning board variances have not been granted. The building <br />commissioner explained the proposal will have to, be heard before the board of zoning appeals foi a <br />special permit to add to a non-conforming building. He noted the parldng lot in a residential area <br />is not a variauce, but a conditional use which can be.granted by planning commission. Mr. <br />Conway further advised the special permit is needed because the front of the existing building is <br />not set back 75 feet offLorain Road. He clarified the board of zoning appeals is strictly going to <br />address the issuance of a special permit because an addition is being installed on a building that <br />does not conform to the code: Mr. Baker questioned if the rear portion of the property would <br />need to be changed to commercial in order to be used for the parldng area. Mr. Conway advised <br />the zoning code permits nursing homes in residential areas if a conditional use is granted. He again <br />stated the conditional use permit is something that the planning commission would address. <br />A. Mauning moved to grant the proposal of Manor Care Nursing Home, a proposal to construct a <br />one story building addition and enlarge the parldng lot with granting of the conditional use, <br />provided that there is no access to Mildred Avenue. Also recommend that the variance to keep <br />one drive entrance be granted if the safety forces have no objections and the variance on the fifly <br />foot setback. Mr. Conway was confused on this motion and requested clarification. The members <br />decided to send this to the board of zoning appeals to address the special permit prior to making a <br />decision on the conditional use. The motion was amended to read as follows: A. Manniug moved <br />to refer to the board of zoning appeals Manor Care Nursing Home's proposal to construct a one <br />story building addition and enlarge the parldng lot, with the recommendation that the special <br />permit and the varia.nce on the fifly foot setback be granted. The one drive entrance shall be <br />referred to tb.e safety forces for approval. The motion was seconded by T. Brennan and <br />unanimously approved. Mr. Brennan advised the commission will be looking for the <br />representative to have addressed the concerns of the commission as well as the residents when this <br />5
