<br />TX. <br />X. <br />zoning code in order to implement the provisions of said new chapter 1167: Sections 11.18.01, 1118.02, <br />1118.03, 1126.06, 1135.01, 1136.04, 1137.02, 1139.01, 1141.02, 1145.03, and 1149.03. <br />It was clarified that this was a new chapter to include towe.rs and putting in restricrions for them. In <br />response to Mr. Brennan's questions, Assistant Law Director Dubelko advised in the case of an <br />accident the city would be held harmless and the developers would have to provide insurance. He <br />advised that this ordinance was created by Building Coimnissioner Conway and any questions should be <br />directed to him. Mr. Tallon wondered if there was any urgency and if there would be a problem with <br />holding this over until the next meeting so the members can have more time to study it. Mr. Conway <br />had no problem with this, but pointed out that there were six carriers and two have approached the city. <br />These structures would only need approval as a minor changes if they were proposed for the Industrial <br />District. The requirements for them in a residential district are the most restrictive. He cautioned the <br />commission that tonight's developer will be back in 5 years for another tower if they are successfuL He <br />advised that eventually these antennas will be mounted on top of street light poles. Of these six carriers, <br />probably one or two will fail, some might even just try to get tower locations to rent them, and not <br />maxket their service. Mr. Tallon asked what the city could do about the company who just built a tower <br />to rent. Mr. Dubelko stated that Federal Law protected the license holders, the city probably would not <br />be under any compulsion for soineone who did not hold a license. Mr. Tallon wondered what would <br />happen if they did hold a license, but did not want this area. Mr. Dubleko believed that if they could not <br />demonstrate their need for their own use, the city would be within its rights to turn it down. Mr. <br />Herbster asked if it would be within the city's rights not to grant 100% coverage. Mr. Dubelko stated <br />that is an issue to look into, but he believed this is a utility which had a right to provide maximum <br />service. Ms. Cameron ALston wondered what the industry standard was, it was possible that they were <br />asking for more than they needed. Mr. Tallon would like to ascertain if the commission had any leeway, <br />or if they would be compelled to make it the best possible. Mr. Dubelko will look into some of these <br />issues before the next meeting. Mr. Conway stated that it would be best to get ahead of other localities <br />so the city is not limited to the locations that will service the area. The city does not want to be in a <br />position where other suburbs are controlling where we can put ours. Mr. Brennau stated that people <br />are not used to the poles, but it is a lot invasive than the other utilities. The members will discuss the <br />ordinance at the next meeting. Mr. Herbster would like a consultant to study it. Mr. Conway did have a <br />consultant, but it did not work out. The commission might recommend this to the administration. Mr. <br />Dubelko had att ended seminars, and has some knowledge, but planning coininission could recommend <br />hiring a consultant with more expertise. R Tallon moved to keep Ord. 97-73 in committee and would <br />make recommendations at the next meeting. The motion was seconded by Ms. Cameron Alston, and <br />unanimously approved. <br />OLD BUSINESS: <br />No items. <br />ADJOURNMENT: <br />R Tallon moved to excuse the absence of Mr. Koeth and Mr. Manuiug, seconded by T.
