He advised this proposal will return on <br />December 9, 1997 at 7:30 P.M., and notification will not be sent out because it is a continuation of <br />tonight's meeting. Mr. Tallon fiuther noted the counnissions office did give five days notice for this <br />meeting which complies with the ordinance. The motion was seconded by T. Brennan and unanimously <br />approved, motion carried. <br />A resident speaking from the audience would like to see the plans for the reorganization of the easement <br />and noted The Illwninating Company has encroached on the easement in the past. <br />N. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />1) Rini Brothers Lot Consolidation Plat. <br />The proposal is to combine permanent parcel nos 233-26-001 and 233-26-002 the site of the approved <br />Rite Aid Drug Store, into one (1) parcel. Location is the north side of Lorain Road near Stearns Road. <br />Zoning is Retail Business, General entirely and the proposal conforms to frontage and area requirements <br />of the Zoning Code. <br />Mr. Strelau, architect, presented the proposaL Mr. Herbster questioned if Rite Aid intends on applying <br />for a variance to sell alcohoL Mr. Strelau advised he has not heard anything at this point. The members <br />had no fiarther questions. Mr. Tallon opened the discussion up to the audience, but no interest was <br />expressed. <br />R. Tallon motioned to approve Rini Brothers Lot Consolidation Plat. Herbster and unauimously approved, motion carried. <br />2) Broxbourne Road Extension (east) Revised Dedication Plat and Improvement Plan (Previous provosal <br />heard 9/23/971. The proposal is to extend Broxbourne Road (pavement and water main) to the east <br />within a currently platted right-of-way and fronting five (5) platted lots. The revised proposal includes an <br />upgrading of pavement to current city standards, dedication of additional right-of-way on the north side <br />of Broxboume Road, and the re-platting of the five (5) existing lots into four (4) lots. Zoning is C- <br />Residence, Single entirely, and none of the proposed four (4) lots conform to zoning code requ.irements <br />for frontage: all other lot requirements conform. <br />Mr. Mowinski explained the variance request would be for approximately four feet on each lot. It was <br />noted three lots are owned by Mr. Mowinski and two are owned by Mr. Sauter. Mr. Deichmann advised, <br />when the zoning code was enacted there was a requirement that if two non-conforming lots have the same <br />ownership they would have to be combined to create lots that conform to the code requirements. Mr. <br />Tallon confirmed lot number 158 is the lot that is legally non-conforming. Mr. Deichmann stated several <br />years ago Mr. Simmon's requested a variance to bu.ild a house on a lot less than 60 feet in width. This lot <br />was also on Broxbourne and the variance was granted. Mr. Tallon asked if there was available land on <br />either side of Mr. Simmon's lot. Mr. Deichmann believed there was a house on each side of the lot -which <br />was under separate ownership. Mr. Ta.llon noted this plan has a key which shows the square footage for <br />lots A-1 through A-5. He wondered if this was related to the square footage of the lots. W. Mowinski <br />advised the areas marked A-1 through A-5 indicate the portions of the lot that will be dedicated. Mr. <br />Tallon questioned if the right-of-way is measured from the center of the cul de-sac. Mr. Deichmaun <br />explained the small circle d.ivided into four quadrants pin points the center of the cul de-sac. Mr. Tallon <br />5
