He <br />noted the board should verify which sign is approved and which sign would be removed due <br />to the non-conforming status. Mr. Maloney believed the board should also stipulate their may <br />be two businesses on the one ground sign. Building Commissioner Conway advised, if Med <br />Center agrees to allow Kaiser on their sigu, the variance for two ground signs can be <br />removed. Mr. Gomersall confirmed the board will not allow the variance to erect a second <br />free standing sign on this -property. <br />R. Gomersall moved to grant Med Center, 25757 Lorain Road, the following request for <br />variances predicated on the pole sign being removed: a 2 square foot variance in excess of the <br />maximu.m allowable for free standing signage and a 3 square foot variance in excess of the <br />total signage allowable for a business use. All variances granted will be conditional that come <br />January 1, 1998, if the Kaiser sign is removed, space will be allowed on the Med Center sign <br />for Kaiser. This Med Center signage shall be exempt from Ord. 1163.26 pertaining to <br />removal of non-conforming signage. The motion was seconded by J. Maloney and <br />unanimously approved. Variance granted. 3. Timberview Homes. P.P. # 235-12-061 <br />Request for variance (1123.12). <br />Re.quest the following variances for the construction of a two story dwelling: <br />a 139 square foot varianoe for first floor area; a17 foot front setback variance; a 3 foot <br />side yard variance and a 4 foot variance on each side of proposed dwelling for distance <br />from adjacent dwellings. <br />Violation of Ord. 90-125, Section(s) 1135.03 (b), 1135.06 (a) and 1135.07 (a) <br />Heard by board of building code appeals March 27 & Apri117, 1997. <br />Chairman Gomersall called all interested parties before the board. The oath was administered <br />to: Mr. Dunlap; Mr. McDonald; Mr. and Mrs. Hamilton; Mr. Czuchran; Councilman Nashar; <br />Mr. Costa; and Mr. Miller. Mr. Dunlap, bu.ilder, presented the proposal to build a house on a <br />lot that is 40 foot wide and 140 foot deep. The proposed house is 27 feet wide, with the <br />inclusion of an attached garage and total side yard of 13 feet. Mr. Dunlap explained a 3 foot <br />variance is needed for the distance between each side of the proposed dwelling and the <br />neighboring property lines and the 139 square foot variance because there are two floors. He <br />noted at the two previous meetings the neighbors had concerns about worsening the existing <br />drainage problem. The engineering department gave a recommendation on the type of <br />drainage that should be used for this parcel of land, and Mr. Ihuilap agreed to install the <br />dtainage as requested. Mr. Gomersall wondered if Mr. Dunlap intends to install the type of <br />drainage that was recommended, as he believed it was merely a suggestion and not <br />mandatory. Mr. Dunlap advised this drainage was highly suggested as the previous board <br />believed this was necessary and the intention is to install the drainage as suggested. <br />Continuing with his proposal, Mr. Dunlap explained a distance of 15 feet is required between <br />dwellings, therefore a 4 foot variance on each side is required for distance between dwellings. <br />Mr. Gomersall read the variance requests the board will decide on today. He advised the lot <br />has akeady been deemed a buildable lot, so this is no longer an issue. Mr. Maloney wondered <br />3
