Mr. McDonald explained he is the present owner of the lot and. <br />did not want to continue paying taxes on a vacant lot. He believed this new home will <br />improve the value of everyone's home in the neighborhood. In response to Mr. Millers <br />question, Mr. McDonald explained the drainage on his lot, abutting the proposal, and agreed <br />to redirect his downspout so that it no longer drained on this vacant lot. Cou.ncilmau Nashar <br />has heaxd the concerns of the neighbors and believed this home would be a nuisance and a <br />safety hazard. He wondered if the home could possibly be moved closer to the street to allow <br />the Hamilton's more privacy. Mr. Dunlap explained there is one window on that side of the <br />house and two on the other. Mr. Gomersall explained the windows are similar to other <br />windows all over town and Mr. Hamilton disagreed because the levels are different as he <br />believed it is easier to look down into a room than at the same level. Mr. Dunlap advised the <br />house to the south is setback 27 feet; the house to the north 50 feet; and the proposal is to <br />build this house 33 feet back aud stagger it between the abutting houses. He noted moving <br />the house closer to the street would shorten the driveway. The members did not want to <br />consider a greater setback variance, because of the appearance. Mr. Duvlap suggested that <br />Mr. Hamilton purchase a blind. Mr. Costa believed his concerns were not being heard and the <br />meeting was a waste ofhis time. The board did not want to deprive Mr. McDonald the use of <br />lus land, as he is paying the taxes on this vacant lot. Mr. Hamilton offered to purchase the <br />property. Much of the discussion here not audible as several people were talking at the same <br />time. Mr. Hamilton explained, he was once told there is no way a house can be installed on <br />this lot. Mr. Gomersall advised this information was incorrect as this lot is buildable. Mr. <br />Duulap agreed to flop the house so that the garage is on the left side and the dwelling would <br />be moved further to the south and away from W. Hamilton's home. Mr. Miller restated the <br />safety concern. The board believed flipping the home would move it three feet over and <br />appease the safety concern somewhat. Mr. Nashar recommended that the motion reflect the <br />flopping of the home. <br />J. Maloney moved to grant Timberview Homes, P.P. # 235-12-061 the following variances for <br />the construction of a two story dwelling: a 139 square foot variance for first floor area; a17 <br />foot front setback variance; a 3 foot side yard variance and a 4 foot variance on each side of <br />proposed dwelling for distance from adjacent dwellings. All variances granted were <br />conditional upon the drainage being consistent with the engineering departments <br />recommendations and that the proposed design of the home presented at the meeting be <br />flipped. Violation of Ord. 90-125, Section(s) 1135.03 (b), 1135.06 (a) and 1135.07 (a). The <br />motion was seconded by R Gomersall. Roll call on motion: J. Maloney, R. Gomersall, T. <br />Kobema, and W. Purper, yes; and P. Miller, no. Variance granted. Mr. Hamilton advised he <br />would like to appeal this decision to the court and asked how he can proceed. The build.ing <br />commissioner advised Mr. Hamilton to contact an attorney as this must be appealed through <br />the couTt. (OoTE ; P)UWJG <br />4.
