The building commissioner explained that the fence should be positioned so that <br />when an inspector comes out and stops his car with the bwnper at the sidewalk there is a <br />visual line. Mrs. Hall explained the bushes along the old fence appeared to be there for a long <br />time, and never caused the former owner any problems as far as site is concerned. Mr. <br />Conway noted that is because a complaint was never filed. He stated this proposed fence is <br />before a public body, and there is a safety concem which the board should address. Law <br />Director Gareau advised an ordinance was passed approximately four years ago requiring <br />people to remove bushes that impose a site problem or safety hazard. The members discussed <br />moving the fence back 15 feet. Mr. Hall noted 15 feet would put the fence in the center of the <br />tree. Mr. Purper stated the fence can be moved farther back so that it is inside the tree line. <br />Mr. Conway believed the members can give the building department some kind of direction so <br />that something can be worked out to assure a safe distance is maintained. Mr. Hall noted the <br />purpose of the proposal was to enhance the property value. Mr. Koberna agreed this fence <br />would enhance the property, however the board would be negligent if they did not add.ress the <br />potential safety hazard. Mr. Gomersall wondered if the board would agree to installing the <br />fence post 1.5 feet offthe sidewalk and allowing the building department to address the cutoff <br />to assure a safe distance is maintained from the right-of-way. The members had no problem <br />with approving the proposal as long as the specifics are stipulated in the motion. <br />T. Koberna moved:to grant Dennis Hall, 3488 Walter Rd. an amended and agreed upon <br />request for a 25 foot variance for the location of fence, on a corner lot, which will encroach <br />into the required 50 foot setback of the abutting lot, with the exception that the building <br />department shall work with the owner to establish the proper site lines from the garage to the <br />side walk area. Violation of Ord. 90-125, Section 1135.02 (f-2). The motion was seconded <br />by J. Maloney and unanimously approved. Variance granted. <br />8. Stephen Hanlon, 6316 Somerset Dr. <br />Request for varia.nce (1123.12). <br />Request a 30 square foot variance for area of shed in excess of 2% of the rear yard area. <br />Violation of Ord. 90-125, Section 1135.02 (d-1). <br />Chairman Gomersall called all interested parties before the board. The oath was administered <br />to Mr. Haulon, owner. The members had no problem with this request. <br />R. Gomersall moved to grant Stephen Hanlon, 6316 Somerset Dr., a 30 square foot variance - <br />for area of shed in excess of 2% of the rear yard area. Violation of Ord. 90-125, Section <br />1135.02 (d-1). The motion was seconded by W. Purper and unanimously approved. Variance <br />granted. <br />9. Joe Flowers, 4813 Grace Road <br />Request for variance (1123.12). <br />Request special permit to enlarge non-conforming building. <br />Violation of Ord. 90-125, Section 1165.02 (b-1) <br />Request the following variances to enlarge non-conforming garage: <br />a 1' 1" side yard setback variance to maintain existing distance from property line; <br />8
