r" , ',' -I% - <br />OLD BUSINESS: <br />Timberview Homes, PP#235-12-061 Review of conclition. Heard May 1, 1997. <br />It was noted Timberview Homes would like to flip the house back to the way it was originally presented. <br />Mr. Dunlap, representative from Timberview Homes, has received a signature from all of the residents <br />notified for the May 1, 1997 meeting in support of flipping the home back so that it is uniform with the <br />rest of tlie homes on the street. The members agreed the home can be flipped back to the way it was <br />originally presented. The clerk questioned if the minutes need to be revised. <br />R. Gomersall motioned to revise the minutes of the May 1, 1997 meeting where the request for variance <br />for the construction of a 2 story dwelling; a 139 square foot variance for the first floor area; a 17 foot <br />front setback variance; a 3 foot side yard variance; and a 4 foot variance on each side of proposed <br />dwelling for distance from adjacent build.iugs. Revised to flip the home back in accordance with the <br />original plans as stated in the motion of May l, 1997. THIS MOTION WAS WITHDRAWN. Law <br />Director Gareau advised that the board should amend the prior variance that was granted to reflect the <br />flipping of the home back as it was originally requested. Somehow the clerk will have to put on the May <br />1, 1997 minutes that the ruling was modified in the September 4, 1997 minutes. R. Gomersall moved to <br />amend the condition of the variance granted May 1, 1997 to Timberview Homes (P.P. 235-12-061) <br />allowing the design of the home to be ui accordance with the original request for the foot print. The <br />motion was seconded by T. Koberna and unanimously approved. <br />Assistant Building Commissioner Rymarczyk wondered if the board can set a period of time which a <br />proposal can be tabled. He explained there are two signs (Jiffy Lube and Debbie D's) that have been <br />tabled for some tune. Law Director Gareau advised according to Roberts Ru1es of Order when <br />something is tabled it dies. He clarified if a proposal is continued till a-date_ certain, the case would be <br />continued until a date certain. Mr. Koberna believed eventually the books should be cleared. Mr. <br />Gareau advised as a housekeeping measure the applicant should be notified, unless they make <br />anangements to be placed on the agenda the next month, action will be taken to permanently table the <br />case. Mr. Koberna questioned if Debbie D's has given up on their request. Mr. Rymarczyk advised <br />Debbie D's has not come to any conclusion at this time: He questioned if the suggestion is to call both <br />parties and advise them if tliey do not appear at the next meeting they will be washed off the agenda. <br />Mr. Gareau agreed; as a courtesy, tliese people should let us know because they are takmg up a spot on <br />the agenda. Mr. Gomersall explained this type of case should be placed at the end of the agenda. Mr. <br />Rymarczyk wondeied if it can be determined for future meetings that if a proposal is tabled, and the <br />representative does not appear at the next meeting they will be permanently dropped. Mr. Gareau stated <br />there are extenuating circumstances and the board should have the right to table a case to a date certain. <br />He advised if someone is on the agenda and they do not °attend the meeting it,can be voted on. The clerk <br />was told to contact these two applicants and questioned what she should tell them Mr. Koberna <br />explained they should be told if they do not attend the next meeting action will be taken with or without <br />their presence. <br />The meeting was adjoumed at 9:15 P.M. <br />R <br />a , .-.,- ? - .,,,,?v. <br />A.
