*i • ?
.?
R. Gomersall moved to grant to the Homestead Village, 24851 Country Club Boulevard, a 3 foot
height variance for the ground sign with the notation that this sign be exempted from Ord. 90-125,
Section 1163.26 concerning the amortizing of non-conforming signs. Violation of Ord. 90-125,
Section 1163.12(b). The motion was seconded by J. Maloney, and unanimously approved. Variance
granted.
After the motions were made, Chairmau Gomersall asked that the exemprion from Section 1163.26 be
included in them.
3. William and Kellv Saringer, 6256 Surrey Dr.
Request for variance (1123.12). Request 23 foot variance to construct 6 foot fence in rear yard of a
corner lot which abuts the side setback of the adjacent house on the side street. Violation of Ord. 90-
125, Section 1135.02.
Chairman Gomersall called all interested parties before the board. The oath was administered to
Mr. and Mrs. Saringer, and W. Keating, representing his mother who is a neighbor. Mr. Gomersall
stated that he received an objection to this from another neighbor. Mr. Saringer explained that there
was an existing fence belonging to a neighbor which they would not be replacing, but they were
replacing fencing on their own property. Mr. Keating stated that the existing fence on their property
was a rail fence, not a solid fence. He stated that his mother's property was being fenced in now. It
was clarified that his mother lives across the street Mr. Saringer stated that they had a dog they
wanted to keep in and they also had a sun room in the back which is open to the corner and they need
some privacy. Mr. Gomersall asked if they would agree to a five foot fence, and he personally would
like it further off the sidewalk, at least 5 or 6 feet, so there would be better visibility. Mr. Saringer
agreed. The fence in back did not need a variance. Mrs. Saringer asked if they changed from a privacy
fence to an open fence would there still be a problem with how far from the sidewalk they could go.
She was advised that they would still have to keep it away from the sidewalk on Cambridge Drive. It
was agreed to start the fence 10 feet off the edge of the d.riveway toward the rear of the house and 5
feet offthe sidewalk. After some discussion, Mr. and Mrs. Saringer agreed to the amend their request.
J. Maloney moved to grant to William and Kelly Saringer, 6256 Surrey Drive, an amended, mutually
agreed upon request to conshuct a five foot fence in rear yard of a corner lot which abuts the side
setback ofthe adjacent house on the side street, the fence shall be 5 foot offthe sidewalk and 10 foot
toward the rear of the house off the driveway. The motion was seconded by W. Purper, and
unanimously approved. Mutually agreed upon variauce granted.
4. Christian Meeting Corporation, 4751 Clague Rd.
Request for variance (1123.12). Request a variance to have 20 parking spaces less than requ.ired.
Violation of Ord. 90-125, Section 1161.05(g).
Chairman Gomersall called all mterested parties before the board. The oath was administered to G.
Wyman, a trustee of the church. Mr. Gomersall read the minutes of July 12, 1994 when construction
of this church was discussed by planning commission. At that time Mr. Wyinau stated that the chapel
was designed for 40 people and they would only have about 10 cars. He also stated that they would
accept a few more members, but if the congregation doubled, they would look for another site. Mr.
Wyman explained that they have 42 members who meet there regularly, and they are not using all the
parking at this time. There are 38 members who go to the church on Crrayton Road, and they would
like to meet together occasionally. Mr. Gomersall asked where the cars wouid park. Mr. Wymau
4
