He wondered what this home might be used for ten years from now, if the variances <br />are granted today. Mr. Tirka was not necessarily opposed to this proposal, but was concerned aboui <br />businesses infringing on this single family residential zoning. Mr. Gomersall noted Mr. Moran camf <br />before this board previously and requested several variances to enlarge his dwelling. At that time, <br />Mr. Moran assured the members of the board the intended use was for his family. These variances <br />were granted based on the fact the home would be used as a single family residence. Mr. Maloney <br />advised there is 8.384 acres of property. He clarified, Mr: Moran could, move the driveways on the <br />north and south sides so that no variances would be required. Mr. Purper believed the traffic pattem <br />on Dover Center Road would be effected if tlus proposal is approved. He-sighted these people will <br />have visitors. Mr. McIntire advised this type of activity would be very nominal. Mr. Ebert noted tlus <br />is a permitted use in a residential area u.uder state statute. He believed the board members should <br />refer the proposal to the law department for legal advice. M.T. Ebert did not believe a variance was <br />required for the north parking lot. Assistant Building Commissioner Rymarczyk advised the <br />variances requ.ired were determined by scaling the site plan. Chaumau Gomersall elaborated <br />variances are required for anything that does not conform to the code. Mr. McIntire stated all the <br />residents will be ambulatory. Mrs. Dingess clarified ambulatory means. a person will require walking <br />assistance from a nurse or aide. Mr. McIntire explained the people living in this home will not have <br />vehicles, but they will be visited occasionally. Mr. Rymarczyk noted he did not figure on any cars for <br />people living there, but only for the incoming traffic caused by them living there. Mr. McIntire <br />agreed to screen the parking if required. Mrs. Dingess explained there are already eight or nine <br />vehicles that come and go from this property. Mr. Moran stated she was full of c--p. Mr. Gomersall <br />advised this comment was out of order and asked that Mr. Moran refrain from using that language. <br />Mr. Koberna questioned if the site plan was submitted by Mr. Moran, or if it was something the <br />building department drew. He advised there is a note on the site plan that states the frame garage <br />will be moved to five feet offthe property line. Mr. Moran explained this has already been permitted. <br />Mr. Maloney reiterated the dxiveways should be in compliance because there are rooms on both sides <br />of the house. <br />R. Gomersall motioned to approved the proposal of Richard Moran, 4650 Dover Center Road his <br />request for the following: an 11.5 foot side yard variance at north properiy line; a 21.3 foot side yard <br />variance at south property line; a 5 foot variance for driveway at north property line; a 7 foot <br />variance for driveway at south property line; a 15 foot variauce for parking area at north property <br />line and a 20 foot variance at south property line; a 10.5 foot height variance for existing structure. <br />Violation of Ord. 90-125, Section(s) 1118.02(fl(2)(b); 1118.02(fl(3); and 1118.02(F)(3). The <br />motion was seconded by J. Maloney. Roll Callon motion: Gomersall, no; Maloney, no; Purper, no; <br />and ICoberna, no. Variances denied. Assistant Building Commissioner Rymarczyk advised, as a <br />result of tonight's decision, this will not be going to planning commission. <br />4. Chairman Gomersall called all interested parties before the_board. A' e oath was-administered to Mr. <br />Lash and Mr. Perri, Mr. Lash, contractor presented the proposal. Mr. Gomersall advised he did not <br />have a problem with this proposal, however there would be a fire wall on the side abutting the house.
