Maloney moved to grant the request of No Excuses, 27330 Lorain Road, for a variance to have <br />live music in existing bar without adding sound insulation for a period of one year with the condition <br />that a letter from the landlord be submitted to the Building Department granting the permission to <br />have live music on the premises. Violation of Ord. 90-125, Section 1139.01(b)(3)(k). The motion <br />was seconded by W. Purper, and unanimously approved. Variance granted for one year. <br />11. Robert Koeth 5530 Bradley Road. <br />Request for variance (1123.12). Request 4 foot rear yard variance. Violation of Ord. 90-125, Section <br />1135.08(a). Note: The above request variance was granted on June 6, 1996 and has expired. <br />Chairma.u Gomersall called all interested parties before the board. The oath was administered to M.T. <br />Koeth. Mr. Gomersall noted that this variance has expired. The members have no problem with the <br />request. <br />W. Purper moved to grant the request of Robert Koeth, 5530 Bradley Road for a 4 foot rear yard <br />variance. Violation of Ord. 90-125, Section 1135.08(a). The motion was seconded by W. Maloney, <br />and unauimously approved. Variance granted. <br />12. Gary Strieter, 5646 Canterbury Road. <br />Request for variance (1123.12). Request 5.foot side line variance to replace existing detached garage <br />with a larger garage in the same location. Violation of Ord. 90-125, Section 1135.02(c)(2). <br />Chairnia_n Gomersall called all interested parties before the board. Mr. Strieter was not present. Mr. <br />Spagnalo, representing the Viewpoint Home Owners, was present and asked that the request be <br />explained. Mr. Gomersall explained that Mr. Strieter wanted to replace his garage with a larger <br />garage, the existing garage is non-conforming now. The garage will be right on his line. Mr. Spagnalo <br />stated that it would not bother them, but they were concerned since they do have some water <br />problems now and do not want to increase them. The members asked that the Bu.ilding Department <br />check the drainage. The members discussed tabling the proposal until a representative was present. <br />Law Director Gareau suggested that it should be passed. It was agreed to vote on the request. <br />7. Maloney moved to grant the request for Gary Strieter, 5646 Canterbury Road for a 5 foot side line <br />variance to replace existing detached garage with a larger garage in the same location on the <br />condition that he has adequate drainage in eompliance with the Build.ing Department so as not to <br />flood the neighbors' property. Violation of Ord. 90-125, Section 1135.02(c)(2). The motion was <br />seconded by T. Koberna, and unanimously approved. Variance granted. <br />13. J. K. Builders Parce1234-17-037 29723 Bretton Ridge Road. <br />Request for variance (1123.12). Request the following variance to split off sublot `B" from property <br />at 29723 Bretton Ridge Road: <br />a 1900 square foot variance for area of lot; <br />a 71.5 foot variance for average depth of lot; <br />a 28.5 foot variance for average depth of rear yard. <br />Violation of Ord. 90-125, Sections 1135.05(a)(1), 1135.05(a)(3) and 1135.08(a). <br />Heard by plauuing commission September 9, 1997. <br />Chairmau Gomersall called all interested parties before the board.
