<br />T. Koberna moved to grant the request of Ali Hamdan, 23521 Stoneybrook Drive, for a special <br />permit as required by Ord. 90-125, Section 1165.02b(2). Also to grant a 20 foot rear yard variance to <br />construct addition (existing screened in patio will be replaced) Violation of Ord. 90-125, Section <br />1135.08(a). The motion was seconded by J. Maloney, and unanimously approved. Variance and <br />special permit granted. <br />9. Royal Nails 30700 Lorain Road. <br />Request for variance (1123.12). <br />Request a 12 foot side line variance to install ground sign. <br />Request variance to erect a tenaporary grand opening sign for a period of 30 days after meeting <br />date. Violations of Ord. 90-125, Sections 1163.12(b) & 1163.12(g) <br />NOTE: GROUND SIGN IS NON-CONFOliMING AND MUST BE REMOVED BY 1/1/98 <br />UNLESS EXEMPTED FROM SECTION 1163.26. <br />Chairman Gomersall called all interested parties before the board. The oath was adiniuistered to Mr. <br />Phong Tran, owner, and Mr. Woost, a neighbor. Mr. Gomersall asked if they were going to tear out <br />the line of shrubs which will obscure the sign. Mr. Tran stated that he owned the shrubs and Mr. <br />Woost thought that he was going to tear out the shrubs. The site plan was not clear and the parking <br />lot was not shown correctly. Mr. Gomersall has no problem with the sign, but he would like the sign <br />to be seen. It was clarified that the address was 30700 Lorain Road and the house behind was 30710 <br />and this had been verified in the Building Department. <br />W.. Purper moved to grant the request of Royal Nails, 30700 Lorain Road, for a 12 foot side line <br />variance to install a ground signs and a variance to erect a temporary grand opening sign for a period <br />of 30 days after the meeting date. Violations of Ord. 90-125, Sections 1163.12(b) & 1163.12(g), <br />with the notation that this sign be exempted from Ord. 90-125, Section 1163.26 coricerning the <br />amortizing of non-conforming signs. The motion was seconded by P. Miller, and unanimously <br />approved. Variances granted. <br />10. No Excuses 27330 Lorain Road. <br />Request for variance (1123.12). Request variance to have live music in existing bar without adding <br />sound insulation. Violation of Ord. 90-125, Section 1139.01(b)(3)(k). Note: No record of any noise <br />complaints at this location to date. <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Ms. <br />Plu.mmer owner of the business. Mr. Gomersall asked if there was a reason why they could not add <br />the sound insulation. Ms. Plummer stated that she clid not think that it would be needed. Mr. <br />Gomersall stated that, although the adjacent tenants do not have the same hours now, later on the <br />tenants might change and there could be a problem. Mrs. Plummer did not know that she could not <br />have music until recently, and she has only had it one or two times, but she wanted permission to <br />have it if she wanted it. The music usually starts about 10:00 p.m She would be willing to put in <br />sound proofing if the music did bother another tenant. Mr. Maloney asked if she had permission from <br />the owner ofthe center. Ms. Plummer thinks he realizes it, but is not sure. Mr. Maloney believed that <br />the owner'should submit a letter to the Building Department stating that he has no objection to the <br />music. Assistant Bu.ilding Commissioner Rymarczyk explained that the sound ba$ling would only be <br />needed where the band would be playing. She explained that it would only be next to the unit where <br />Enterprise Car rental is located, the other wall is the bar. Mr. Rymarczyk pointed.out that there have <br />been no complaints to the Safety Department against this business. Mr. Miller suggested granting a <br />variance for one year to see if there are any complaints. The members agreed. <br />..., . <br />4
