required, only the location variance. Mr. Smith asked if he could have an 8 by 12 foot shed, but the <br />board still preferred S by 10 foot. Mr. Smith agreed. Mr. Miller questioned if the shed would be in line <br />with the house, and it was explained that the way it was laid out it was 38.5 foot from the front setback. <br />Since the shed is smaller, Mr. Miller wondered if the shed to be in line with the house. Mr. Smith stated <br />that he had planted arborvitae right where Mr. Miller wanted the shed. Since the house is only 45.4 foot <br />from the property line and the shed is 38.5 feet. Mr. Rymarczyk stated that since the house is at an <br />angle and he moved it back, they might not need a variance. Mr. Smith repeated that if they put the shed <br />in line with the house, he will have to dig up his trees. <br />T. Koberna moved to grant the request of S. & B. Smith, 27919 Wisteria Drive for 11 foot, 6 inch <br />variance for a shed which will be adjacent to the front setback of the first house on the abutting street. <br />This is a mutually agreed upon variance requested for the area of the shed which will be 8 by 10 feet. <br />Violation of Ord. 90-125, Section 1135.02(d) and 1135.02(d)(1). The motion was seconded by R. <br />Gomersall, and unanimously approved. Variance granted. <br />2. Kermit Lautebach, 23815 Delmere Drive. <br />Request for variance (1123.12). Variance to construct a carport (not a permitted structure). Also <br />request 12 foot, 6 inch side yard variance and 8 foot variance for distance between adjacent dwelling <br />and proposed carport. Violation of Ord. 90-125, Sections 1135.07(a). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. and <br />Mrs. Bender, neighbors who would abut the carport, and are objecting to the request. Pastor Lautebach <br />was not present. Mr. Bender had told Pastor Lautebach that they would be objecting to a carport beside <br />their house. He did not think it was fair to the people across the street either. He also wondered what <br />would happen if he had been on vacation, and could not be present for this hearing. The members <br />advised that the variance would be considered on its own merits, and it would not necessarily be <br />granted. Mr. Gomersall noted that Rev. Lautebach had a one car garage. Mr. Bender thought that he <br />could use the garage, since he has to go out in the middle of the night on emergencies, and his wife's car <br />could stay outside. It was determined that the board could vote even though he was not present. Pastor <br />Lautebach had advised that he could not attend the meeting because of an emergency surgery of one of <br />his parishioners at 4:00 p.m, Mr. Bender maintained that he was not present because he knew they were <br />going to protest it. Mr. Gomersall noted that he had stated that he had written two letters to the board <br />so his case in the record, even though he was not present. <br />W. Purper moved to grant the request to Kermit Lautebach, 23915 Delmere Drive, for a variance to <br />construct a carport (not a permitted structure). Also request 12 foot, 6 inch side yard variance and 8 <br />foot variance for distance between adjacent dwelling and proposed carport. Violation of Ord: 90-125, <br />Sections 1135.07(a). The motion was seconded by T. Koberna. Roll call on motion: Purper, Koberna, <br />Miller, and Gomersall, no. Motion failed to pass. Variance denied. <br />3. T. & A. Deanovich, 24907 Gessner Road. <br />Request for variance (1123.12). Request 2 foot side setback variance; request 5 foot rear setback <br />variance; and 2 foot variance for distance between proposed detached garage and dwelling. Note: <br />existing attached garage will be converted into living area. Violation of Ord. 90-125, Section <br />1135.02(c)(2). <br />Chairman Gomersall called all interested parties before the board. The oath was admivistered to Mr. <br />= Deanovich and E.
