? <br />Violation of Ord. 90-125, Section 1163.04(h); 1163.12(b) 1163.11(a); 1163.12(b) and 1163.11(a). <br />NOTE: THIS WRITE UP IS PREDICATED ON TBE KIOSK VARIANCE WHICH WAS <br />SUBMITTED PRIOR TO THIS PROPOSAL. <br />NOTE: NON-CONFORIVIING SIGNS MUST BE REMOVED BY JANUARY 1,1998 PER <br />ORDINANCE 90-125 5ECTION 1163.26, iTNLES5 AN EXEMPTION IS GRANTED BY THE <br />BOARD OF ZONING APPEALS. <br />Chairman Gomersall called all interested parties before the board. The oath was admiuistered to R <br />Bayus, sign contractor, who explained that the monument sign will have the same design that is on the <br />kiosk. He pointed out the location of the sign and explained that they do not meet the setback from the <br />road and is in the prohibited triangular area. Mr. Miller noted that if the sign were moved, it would be <br />obscured by the bushes and this would seem to be a safer location. Mr. Bayus explained that only the <br />graphics on the sign will be illuminated. The members had no problem with the request. <br />W. Purper moved to grant the request of Ohio Savings, Allied Lighting, 4800 Great Northem <br />Boulevard for the location variance for ground sign which is in the prohibited triangular area; a 22 foot <br />side line variance for location of sign; a 46 square foot variance for sign area allowed for a business use; <br />a 2 foot 1 inch height variance; and a 21 square foot variance for sign face area for a ground sign with <br />the notation that this sign be exempted from Ord. 90-125, Section 1163.26 concerniug the amortizing <br />of non-conforming signs. Violation of Ord. 90-125, Section 1163.04(h); 1163.12(b) 1163.11(a); <br />1163.12(b) and 1163.11(a). Variances granted. <br />6. Rite Aid (D.A.S. Construction Co.), 29000 Lorain Road. <br />Request for variance (1123.12). Request a 64 foot front set back variance to have a job trailer and porta <br />john in front set back. Violation of Ord. 90-125, Section 1139.07. <br />Chairinan Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Scholl, contractor, and Mr. Boss, adjacent property owner. Mr. Scholl explained that the trailer was in <br />a front grassy area which was the only suitable area for it, not only because of the amount of work in <br />grading, but also because of the relationship to the telephone pole. He estimated that the trailer will be <br />there for another 45 to 60 days and they will remove the trailer as soon as the building is closed in. The <br />porta john is located on the back side of the trailer and it will be removed when the trailer is removed. <br />Mr. Boss had no problem with this location. The members were going to stipulate a 60 day maximum, <br />but Mr. Miller believed that it should be 75 days in case there were weather problems. <br />J. Maloney moved to grant the request of Rite Aid (D.A.S. Construction Co.), 29000 Lorain Road, <br />for a 64 foot front set back variance to have a job trailer and porta john in front set back f or a period <br />of 75 days. Violation of Ord. 90-125, Section 1139.07. The motion was seconded by P. Miller and <br />unanimously approved. Variances granted. <br />7. Petland, 4670 Great Northern Blvd. <br />Request for variance (1123.12). Request 6 square foot variance for total sign area allowed for a <br />business u.nit to add a logo to existing wall sign. Violation of Ord. 90-125, Section 1163.11(c). <br />NOTE: NON-CONFORMING SIGNS MUST BE REMOVED BY JANUARY 1, 1998 PER <br />' ORDINANCE 90-125 SECTION 1163.269 iTNLESS AN EXEMPTION IS GRANTED BY THE <br />BOARD OF ZONING APPEALS. <br />4
